Justice Sotomayor: Hispanics have 'rational fear' of Trump administration citizenship question

Justice Sonia Sotomayor said Tuesday that Hispanics may have a “rational fear” of their answers to the census being misused by the Trump administration, as she argued against including a question about citizenship in the 2020 count.

The Supreme Court heard oral argument on the thorny question, with the liberal justices saying they feared millions of people — Hispanics in particular — will toss the forms into the trash rather than fill them out, distorting the entire 2020 count.

“Are you sure they don’t have a rational fear?” Justice Sotomayor challenged the government’s lawyer.

The government said the question has been asked before, provides important information and besides, refusing to answer the census is illegal, so catering to the potential for Americans’ to take illegal action is fraught with its own perils.

Besides, there are ways to go out and find people who refused to fill out their forms, thus ensuring the government can get the information it needs — including citizenship information, said Noel Francisco, the U.S. solicitor general, arguing the case for President Trump and the administration.

He said the citizenship data is worth it even if it means more hassle and the potential for fewer responses.

“There’s always going to be a tradeoff,” he told the court.

A citizenship question was standard on the full census for more than 100 years, then was shunted to the so-called “long form” census along with a bunch of other demographic and sociological questions in 1960. It’s still asked now on the American Community Survey, another census survey, though it’s not part of the questionnaire that goes to everyone.

That history complicates the argument over adding it back in.

Is the dreamer situation settled law? It certainly needs to be. They would probably fear ticking the non-citizen box. What a mess!

I will gladly state I am a U.S. citizen.
BUT i will be damned if I answer any intrusive questions about my sex life, religion or how I vote.
I refused to fill out the last one due to this.

Someone needs to remind The WIDE LATINA that questions presented to the SCOTUS are supposed to be decided on the basis of law, NOT catering to a particular interest group.

I hear you - but PLEASE check the judicial voting records of Romney, Collins, Murkowski [to some extent], and others.

Bill Barr just LAID OUT THE LAW regarding spying on Trump...but how did he get to be confirmed as AG?

Every RINO in the US Senate voted for him, including the 3 above. One Republican voted against him...the ‘principled’ Rand Paul. But the RINOs stuck with Trump and now the Democrats are SCARED SHITLESS that their entire coup operation is about to blow wide open.

Point being that in my decades of following politics, there are very few exceptions regarding a November vote - people here [not you, but others] literally said ‘DON’T WORRY ABOUT MANCHIN, HE’S THE REAL THING’. Well, he certainly WAS NOT for Kavenaugh, and only announced his vote 5 minutes after Collins [yet another RINO] gave Kavenaugh his 50th vote...Manchin, by far the most conservative Democrat in the Senate today, was not about to buck Schumer.

The Democrats are now HORRIFIC - they could care less about what happens to this country, or, for that matter, the entire concept of Western Civilization...we should NEVER support their efforts, and if there is a RINO running, then take him out early, in the Primaries...before it results in the Dems owning yet another seat

Speak for yourself, Sotomayor. I’m at least a fifth generation American Hispanic and you can ask me my citizenship all day. American citizens and other people here legally have nothing to fear.

She is a liberal minority judge and feelings and partisan politics trumps everything: The Constitution, legal president, everything. The only hispanics who might fear that question are in the country illegally, and they will fight to the death to defend those criminal illegal aliens. US citizens be damned; they have a nation to conquer by invasion.

Worse?

Average life expectancy for a Type I diabetic woman is 68 years... Sotomayor is currently 64 years old.... Given she’s a supreme court justice, and will get the best possible health care available, she’ll probably outlive the average age, but she won’t be in the bench for another 10 years, health will drastically decline even with the best care.

It is possible Trump could name her replacement before the end of his 2nd term.

I read her health is actually worse than that, I read she has both Type I and Type II. She also has a very poor diet, gets almost no exercise and pretty much does nothing to help herself. Given those factors she could have a heart attack or stroke at any time. Medicine can only help her so much. She has to help herself.

I don’t know anything about her health other than it being publicly known she is a Type I diabetic, and won’t speculate about it, because the only people that know that are her and her doctors and nurses etc, anyone telling you otherwise and would actually know would have to have her permission do disclose it or would be in violation of Federal Law... and no doctor or nurse is going to likely risk their career just to flap lips about someone.

So, any hearsay about her health is purely that as far as I’m concerned.

However, there is no denying that she won’t be an RGB... even with the best care, and helping herself, her health will rapidly deteriorate. While she will likely outlive the average for a Type I... the health impacts from it will almost certainly make her unable to do the job, well before she finally succumbs to the disease.

on other notes.. I expect Bryer to likely announce his retirement after the election, probably holding on to hope a D gets elected... but after it doesn’t happen will not hold out for 3 more years.

Thomas would be one to watch as well. If he doesn’t retire under Trump looking at a possible 8 years before he could retire with a GOP president, so I wouldn’t be surprised if he retired after the 2020 election as well.

I am only repeating what I read recently on her health. But it is probably true she doesn’t do much to help herself. I read she has not altered her diet which for her is important and she also probably does not get much exercise either. My point is she could help herself but she doesn’t seem to be doing so. By the way I am a Type II diabetic and I try and watch my diet and get plenty of exercise.

She certainly has advantages the rest if us don’t.
