Justice Sonia Sotomayor said Tuesday that Hispanics may have a “rational fear” of their answers to the census being misused by the Trump administration, as she argued against including a question about citizenship in the 2020 count.
The Supreme Court heard oral argument on the thorny question, with the liberal justices saying they feared millions of people — Hispanics in particular — will toss the forms into the trash rather than fill them out, distorting the entire 2020 count.
“Are you sure they don’t have a rational fear?” Justice Sotomayor challenged the government’s lawyer.
The government said the question has been asked before, provides important information and besides, refusing to answer the census is illegal, so catering to the potential for Americans’ to take illegal action is fraught with its own perils.
Besides, there are ways to go out and find people who refused to fill out their forms, thus ensuring the government can get the information it needs — including citizenship information, said Noel Francisco, the U.S. solicitor general, arguing the case for President Trump and the administration.
He said the citizenship data is worth it even if it means more hassle and the potential for fewer responses.
“There’s always going to be a tradeoff,” he told the court.
A citizenship question was standard on the full census for more than 100 years, then was shunted to the so-called “long form” census along with a bunch of other demographic and sociological questions in 1960. It’s still asked now on the American Community Survey, another census survey, though it’s not part of the questionnaire that goes to everyone.
That history complicates the argument over adding it back in.

Did she specify in what way? Because the question is a pretty straightforward one:
You either ARE a citizen, or you are NOT. It is very black and white, very straightforward.

Why? Why would millions of American citizens refuse to fill them out and toss them in the trash? Hmm?
There is someone who is afraid, very afraid of that question on the census, and it isn't a hispanic citizen.
It is the Democrat Party.

Being a Type 1 diabetic is in and of itself not the major issue.
It is that she is apparently a “fragile” Type 1 diabetic, and has had ED visits related to that according to news accounts I had read in the past.
That is not a good indicator.

Will we ever know? Where’s RBG? The left seem to be able to keep people alive longer or some shorter. Look how sick Hillary was. Now she seems to be in excellent health.
Well, it would have the effect of placing the Democratic Party on the horns of a dilemma, wouldn’t it?
If the question is put on the Census, illegals only have two choices:
One horn is to toss it in the trash and decrease the representation.
The other horn is to out themselves.
Of course, any time you are faced with the horns of a dilemma, you usually do have three choices: take one horn, take the other horn, or try to ride it out between the horns.
Obviously, they will opt for the third choice, which is keeping it off the form, or something else, haven’t thought it through yet.
You are correct on Roberts writing the liberal opinion for a 5-4 opinion that will remove this question from the census. He's still being blackmailed over his adopted children.

Roberts will be writing to allow the question. There is no constitutional basis for not allowing the question.
The only question is how big a majority will he have? 7,8 or 9.
