A law enforcement operation that famously resulted in criminal charges against New England Patriots owner Robert Kraft for alleged solicitation of prostitution included the use of video that prosecutors say caught Kraft in the act. What it also allegedly captured, was an innocent man in a state of undress, and that man is now suing the Jupiter Police and the Palm Beach County State Attorney for violation of his civil rights.

    If they had a valid warrant for the surveillance, and didn’t leak footage outside of the investigation I am not seeing a problem.

    How about telling the owners they had a report of a suspicious package on the premises so the owners would evacuate and surveillance cameras could be installed? If you or I announced there was a suspicious substance in a package so that we could gain access to a building, we would be charged with a crime. But is ok for the police to force an evacuation by scaring the occupants?

    Whatever happened to all the hysteria about this being a sex-trafficking issue? So was there any real sex-trafficking taking place at this dump, or was it just a lame cover story?
 
 Quite frankly, I don't care if what Kraft did is illegal. A lot of things that are none of the government's business seem to be illegal. I don't see how any arrangement between a lonely 75 year old widower and some mentally competent and willing woman in her 50s is anyone else's business. That's not sex-trafficking.

 It's a legal concept : "Fruit of the poisoned tree" 
 In essence, you can't commit a crime (in this case, a false / fraudulent threat of suspicious package)
 in order to gain unauthorized physical access (trespass )
 and then charge someone with criminal action, based on illegal / falsified trespass.

    If, as has been widely reported, the cops used the ruse of a phony bomb threat they themselves called in to gain access to the building and plant cameras, then they could indeed be in for a rough ride legally.
Phoning in bomb threats falls under Federal terrorism laws. A local judge granting a warrant likely can’t override them.
Another case that could tie-up our entire Federal court system for the next thirteen years.
