Illinois Senate to Trump: No tax return, no spot on ballot

Donald Trump will have to release five years of tax returns if he wants appear on the Illinois 2020 presidential ballot, the state’s senate has ruled.

The bill, which still requires approval by the Prairie State’s House of Representatives, comes amid a growing row in Washington over Mr Trump’s unprecedented refusal to make publicly available his income tax returns.

The US Treasury ignored a congressional deadline to release the documents earlier this week. Treasury secretary Steve Mnuchin claimed the request by the House ways and means committee was “politically motivated”.

Mr Trump himself has claimed that he cannot release his tax returns because they are under audit, although technically there is nothing preventing him from doing so.

It is against the law to turn over Trump’s tax returns, by anyone other than Trump. He has refused. That is the law.

Now a state pretends to be able to deny a person a spot on a presidential ticket for following the law?

But what the heck, Trump is not likely to win in Illinois anyway, so those electoral college votes were already pretty well forfeit in that state.

But it does have down-ticket implications. Why go out to vote if you can't vote for your preferred presidential candidate?

As above, I don't think this is Constitutional. The Constitution prescribes the qualifications of a candidate for President, not the states.

(Even if it Trump's tax returns are ordered immediately released by order of some bat**** crazy Democrat judge on a Friday evening, it would be pointless. They are so long and complicated that they are unreadable by anything less than 1000 CPAs. The Democrats will say Trump is rich and pays as little in taxes as he can. I know Trump is rich and pays as little in taxes as he can. I don't care. I would, too, if I could afford 1000 CPAs.)

Thanks for the info. Some folks don’t know how this works in BIG companies. Same thing we dealt with in my career with govt auditors always on hand to ensure contractual requirements were met.

No Trump on ballot, no Illinois Electors in EC.


That’s not how it works. The Illinois legislature is free to appoint its electors anyway it chooses. (Illinois state law may and likely does limit them to awarding Electors to whoever wins the state’s Presidential election). The state can choose who appears on the ballot—again following state law, including this tax-return business.

The Electors chosen will meet in Springfield and vote. The vote is then transmitted to the House of Representatives to be counted. The House can reject electoral votes from states where the election might be in doubt. The House is now in Democrat hands. Think they’ll reject Illinois’s vote? I don’t.

This is just to fuel their popular vote fantasies. If the President is kept off the ballot in several states, he will lose the popular vote by millions. If the electoral votes are not counted in those states, more fuel for the fire.

There are obviously primary candidates who would never want their information disclosed. And most of them are dims.

I'd like to see Maxine Waters' for starters. How does she live in a million dollar house that is not in her district?

Actually, President Trump is not on the ballot, the Electors to the Electoral College are on the ballot. His name is a proxy for the slate of electors. As such, what if we demanded a law that required the actual naming of all 3, or 5, 20, or 30, or 55 electors (times the number of candidates) on the ballot?

Therefore, Trump's taxes cannot be held against an elector's eligibility to be on the ballot. The Constitution clearly lays out the eligibility for an elector:

Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

How is the publication of taxes of the candidate be something that an Elector can control?

Since the Constitution forbids Congress and state legislators from being electors, it was intended for electors to be ordinary citizens. I'd expect these citizens to immediately sue the state over this, saying it is THEIR right to be on the ballot, and Trump's taxes have nothing to do with the execution of THEIR constitutional rights.

Congress will not accept Electors who have violated federal law by setting an illegal condition for appearing on the ballot.

You can take it to the bank that this will go to court and rule for the Republican party.

That’s how it works.

Yep, just showing off to make DJT look bad. The Constitution spells out the requirements needed by an individual to serve as President. Tax forms are not mentioned. Heck, there wasn't even an income tax until the early 20th century. Trump filed his returns. If there are disrupts they are handled administratively, completely apart from the electoral process.

This is the kind of crap that simply motivates people like me to lend more support to PDT. The more the 'Rats try this stuff, the more it will come back to bite them in their a$$.

Don't give the Democrats an inch. Better yet, strike back.

Refuse to seat any electors from Illinois and expel their Congressional delegations. Block all federal funding to the State.

Do the same for California and New Jersey.

President Trump may not win Illinois but many of us would like his name on the ballot. Either that or we would like to see every candidate’s tax returns for the past five years. Personally, I am most interested in hilldawg’s, odungo’s and JB the Hutt’s (IL governor) tax returns.
