We can keep the ports open to commerce, secure our borders, and eat our avocados too
Conservative Review ^ | April 3, 2019 | Daniel Horowitz

The media is missing the point about the president’s inherent and delegated authority to deny entry at the border and the most prudent way to use it. Through statute and case law, the president’s 212(f) authority overrides all other immigration processes, including asylum requests, but it’s important to remember that it’s not an all-or-nothing proposition. It’s not an on-or-off circuit breaker on the operation of our border. There are modules on that switch that the president can engage to strategically address the current situation.

Let’s again review the language of the relevant statute, 8 U.S.C. §1182(f):

Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.

Even if the rest of the general operating statutes were broken (they are not), this statute alone supplies the president with all the authority he needs to deal with such an urgent and devastating crisis, at least in the relative short run. If members of Congress were to get together and craft a new law with the intent of giving the president more power to shut down what is happening today, they could not conceivably have written anything strong than this existing law, which has been in place, in some form, since 1893, particularly to keep out those with diseases.

The law is saying that the president can shut down all migration or any type of migration, while leaving others in place.

Trump used to want to play hardball but he has gone very soft lately. This is what should be done---Shut all immigration down at the border, but leave commerce open until congress gives him legislation to stop illegals.

No, he doesn’t WANT to play hardball. He wants the cooperation of congress, and of Mexico, and a consensus of the American people. Good luck with that, however, so he WILL shut down the border if he must.

the art of the deal.

So this article wants to essentially not punish Mexico with any kind of economic consequences, in hopes that they will magically change their minds about not doing anything about the border.

Got it, this is a Chmaber of Commerce press release.

No, the point of the article is that the negative economic consequences of shutting down the border to US, need not happen (Several republicans have said shutting the border would harm American jobs)

He's not going to get those things certainly not the cooperation of congress. He needs to get bold again. Shut down the border except for commerce until congress revamps asylum laws.

Its time to decide does he want to make America great again, or just slow down liberalism a bit.

There's no deal or compromise to be made on immigration. There actually was a deal in 1986, on to see the rug get pulled out from under Reagan.

I would like to see the Southern border completely shut down and militarized. No trade or travel to and from Mexico. No commerce. If avacadoes and other fruit go up, so be it. I'll buy the frozen packages and make smoothies.

Trump has got to take decisive action on the border NOW.

Normal Americans don’t care about imports but they care about the future of America! All of this “globalist business” stuff cheapens what it means to be an American patriot.

I probably never had an avacado until 40 or so.

Maybe two or three since.

Avacados were on sale at Winco foods yesterday, .98 for pretty big ones so I bought two of them.
But they are basically a nowhere item because you can’t make ice cream out of em!

We would probably not need as many avocados if we deported all the illegal aliens.....

Trump knows stopping the flow of COMMERCE (vs humans) would be harmful to the economy of the US.

We will just go back to the old method where goods are shipped to the border by Mexico and then brought through a warehouse where they are shipped to where they need to go by US truckers.

Is it less efficient than having the Mexican trucks waived through? Yes. But it works. It works just fine.

So Shadow is correct in calling it a COC press release.

He has been educated on the fact that until the deal with China is signed the economic state of the country is precarious.

The floods of the midwest have not even ended yet, and the cost of beef and wheat is going to soar. A good fungal infection (which is normal after floods) would wipe out a lot more of it.

The unemployment rate is down as much from the boomer generation retiring as it is from expansion. Our demographic bleeding has only just started.

Take a good look at what companies are hiring: Lots of six sigma, lots of Agile production folks. Companies are looking to squeeze out as much efficiency as they can—they cannot get employees because they are not coming in at entry level—everyone wants to be a boss.

It is not going to take much to end this business cycle. One good shock and last November/December will be back with a vengeance.

That shock could be economic. It could be political. It could be military. It’s precarious.

And “our” personal finances are horrific. The median net worth for someone in their pre-retirement decade have less than $100,000 in non-home equity net worth. Do you think these people are buying a lot of capital goods? Do you think debt burdened young people 25-35 are spending a lot of money on capital goods?

That leaves folks 35-55 buying EVERYTHING. But THEY re raising kids and going into more debt.

Anyone who thinks we are in “great” shape has not scratched the surface of the gold bar—its just iron underneath.

The next few years will be interesting.
