Motel 6 to pay $12 million after handing guest lists to ICE
CBS News ^ | April 5, 2019

Motel 6 will pay $12 million to settle a lawsuit by the Washington state attorney general over the lodging chain's practice of handing over guest lists to U.S. Immigration and Customs Enforcement agents. The company also committed to no longer provide guest information without a warrant, a policy that will be adopted nationally, prosecutors said.

It's not the first time Motel 6 has faced legal claims for providing guest information to immigration authorities. In November, it agreed to pay up to $7.6 million to Hispanic guests to settle a lawsuit claiming it violated their privacy by sharing guest lists with ICE agents.

Motel 6 locations in Washington state provided personal information about their guests to ICE "on a daily basis without requiring a warrant," according to a statement from the Washington attorney general's office. In total, the motel chain shared information for about 80,000 guests without their knowledge or consent, the statement said.

Private businesses have to cooperate with law enforcement.

Motel 6 is between a rock and a hard place. I am assuming ICE pressured them to hand over the guest lists. What were they supposed to do, if the federal government wants that info?

The illegals who are staying at Motel 6 places have really no right to sue them.

So if it was any other criminal and they didn’t call him/her in, they’d be charged with harboring a criminal.

Government and its laws are so inconsistent and designed to crush whomever it wills.

Laws are only for the chumps. Not them.

Our legal system is screwed up when it goes after people/companies who report something/someone who is breaking the law.

Sanctuary states have gine rogue. Their laws taking precedence over Fed laws in these cases is anarchy.

What a great way for Motel 6 to advertise to illegal aliens to stay out without actually saying “stay out.” Good job.

I’m not sure what the law requires, but I have no problem if a warrant is required by a business before sharing customer records with any government agency.

How would Motel 6 know if their guests are illegal aliens?

The US Attorney should sue the State(s) when Federal law is not complied with as a routine matter. Sanctuary Cities are another case in point.

I’m trying to figure out “probable cause.” It’s leading me to a catch-22. if ICE asks for the guest list, and the motel says no, there is a high probability they are harboring illegals. If they say yes, they’re probably clean.

That makes sense. And there are probably grounds for a warrant. That would take care of the problem, at least from the federal government and the motel chain’s perspective.

How can this possibly be a violation of criminal *or* civil law??? “Dropping a dime” is a very effective way to fight crime!!!

So now you get sued by the government for cooperating with the government, that’s rich. I’d tell Washington state, “Not my problem, go talk to ICE.”

A refusal to turn over customer records without a warrant is NOT “probable cause” for anything. ICE must have probable cause to get the warrant for the records long before they show up at Motel 6.

Not without a warrant they don’t and shouldn’t.
