Supreme Court won't stop Trump administration's bump stock ban originally appeared on abcnews.go.com
The Supreme Court will not stop the Trump administration's ban on bump stocks from going into effect, it was announced on Thursday.
The ban on bump stocks was announced by the Justice Department in December 2018 and took effect on Tuesday. On Monday, the Supreme Court was considering an emergency request from Gun Owners of America, Gun Owners Foundation and the Virginia Citizens Defense League to stay the ban while cases challenging it were appealed.

America as a republic, following the Constitution and rule of law is long dead. We are now simply governed by the whims of individuals. I call it “Jeopardy government”. They do whatever they please, but they have to use sophistry and word games to make it sound “constitutional”.
With this precedent, The next Dem president is now free to “deem” all semi-autos as machine guns with an executive order.
It will happen, mark my words.
I know of no constitutional clause that PDJT can use to reasonably justify his bump stock ban, correction, insight welcome.
PDJT is evidently unsurprisingly getting bad advice from post-FDR era, institutionally indoctrinated attorneys imo. He arguably has had no choice but to surround himself with indoctrinated constitutional experts."
PDJT needs to start reading Free Republic to find out that he has underestimated the size of the swamp.
*sigh* Well, time for another trip to the lake.
You are way way off base in your assesment. This ban will protect absolutely no one and gained nothing for the President or the People. What it has done without question is lost at least a half a million votes, probably a lot more for 2020. The half million people that own bump stocks almost certainly voted for Trump in 2016 and now that most of them are felons waiting to be caught thanks to this ban you can bet your wallet those half million voters wont be voting for the president. No sir they will most likely just sit out the election. I also think the half mil figure is way low and is more likely over a million. In the event this next election is close at all this ban may well lose the election. How many votes did Bush win over Gore? This was a huge mistake.
I saw it more as trading a penny to get a dollar.
You and I agree that the ban will protect nobody. But you and I disagree on what it gained. I believe the gain was only temporary, when the gain was temporarily needed.
And it is quite possible the SCOTUS will overturn it - for obvious reasons.
Are those “tac triggers” on the ban list? I thought it was just bump stocks
The bump-stock ban is the foot-in-the-door for a all out ban in semi-auto weapons!
The demonrats are already plotting how to go forward on a semi-auto ban!.
That’s certainly one way to look at it. It’s the way I saw it at first as well. I’ve changed my thinking, though. And the path was long and convoluted.
Binary triggers aren’t touched by this, from what I’ve been hearing.
“It was one of the rare Trump Caving moments, where he gave up, for all intentions, nothing. “
Wrong. Machine guns have a very specific definition in the law.
“For purposes of federal law, a machinegun is defined as: Any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot, without manually reloading, by a single function of the trigger.”
Trump’s EO now says if anything helps you pull the trigger really really quickly, it is now an NFA weapon. This order means the next democrat can decide that launching 20 rounds in about 3 seconds is a machine gun. They can deem that any weapon that was initially designed as a machine gun may not be possessed in a semi-auto variant.
Goodbye AR, AK, FN, M1919, M2, Thompson, etc.
Another obscure piece of groundwork was laid for this with the MAC-10 and similar guns. If they fired from an open bolt the ATF deemed them machine guns even if they were semi auto. Original Thompsons were open bolt, the new repro semi autos are not.

Look at the rate this non-Mikulek guy accurately blows through this 20 rounder.
He had his reasons after Vegas, Bump stocks were only useful there because he was shooting at a target the size of “minute-of-a Costco warehouse”, they are an idiot’s tool and whatever. But Trump did set a very bad precedent with this ban.
“It is NOT a machine gun. Arbitrarily calling it one and outlawing it is egregious.”
And now stand by for what the next Dem president arbitrarily calls a machine gun.
IE..this is not a bump stock, no tricks, just rapid trigger work.

The RATS WILL ban semi-auto weapons as soon as they get the White House again, day one!!
Give it ten years lol
And what exactly what was the dollar that was gained? Not only did this set the most dangerous president for the second amendment to date it also lost at the minimum five hundred thousand votes for his reelection. No gun legislation was a threat in any way when the President could just veto and no way in hell the banners could have reached an overide majority. The President gained nothing but lost maybe a million votes or more. Why do you think the deep staters are pressing so hard for red flag laws? The reason is they know if Trump signs anything in that area hes done and will never be reelected. They are trying to con him into detroying himself which I maintain was why the bump stock ban momentum was so great. This was the second biggest mistake of his presidency and if 2020 is close it will come back to bite in the worst way. Many an election is lost by far less than a half a million votes.
If self-contradiction was good enough for Walt Whitman, it’s good enough for America.
Trump just lost the 2020 vote, it’s all over but the shouting.
My understanding is that bump stocks were first invented to allow handicapped people to fire a gun.
One of them needs to sue under the Americans with Disabilities Act. That should tie our entire Federal court system in knots for the next thirteen years.
Fortunately, Beto or Berny or Kamalla or whoever will make sure that the election is not even close. It’s like Walter Mondale promising to raise taxes.
Also...
From what I’ve been hearing, the premise is all wrong for the ban.
It started from the murders at Mandalay Bay, yet the FBI wouldn’t allow the ATF personnel inspect the weapons used there.
So, there STILL is no evidence that the murderer even USED bump stocks to commit his crimes.
Excellent idea!
