Robert Kraft Requests Jury Trial In Florida Prostitution Case

BOSTON (CBS) – Patriots owner Robert Kraft waived an upcoming court appearance in his Florida prostitution case and is requesting a jury trial, according to a court document filed Tuesday.

Kraft had previously pleaded not guilty to all charges and was requesting a non-jury trial. Kraft was due in court for his arraignment on Thursday, but waived his right to appear and changed his trial request.

With his Thursday hearing officially canceled, Kraft is next due in court on April 9.

The Patriots owner was charged with paying for sex acts inside a Jupiter massage parlor twice on the weekend of the AFC Championship Game.

Prosecutors had offered Kraft a plea deal. He rejected the offer to have charges dropped in exchange for admitting he would likely have been found guilty at trial.

On Friday, Kraft issued an apology.

“I am truly sorry. I know I have hurt and disappointed my family, my close friends, my co-workers, our fans and many others who rightfully hold me to a higher standard,” Kraft said. “The last thing I would ever want to do is disrespect another human being.”

Kraft faces possible punishment from the NFL. League owners reportedly will not decide on a possible suspension until Kraft’s legal issues are resolved.

I believe his lawyers are trying to suppress the evidence by arguing that the surveillance and traffic stop were illegal. If so, his guilt can’t be proven.

Well, he gets rid of football fans that aren't Pats fans in the selection pool, and he plays the "lost my wife to cancer" "victim" card (neglecting to mention his liaisons with a very low-rent hooker while his wife was dying, and the subsequent blackmail attempt, btw), and he's not exactly a spring chicken, so he has the elderly man seeking "companionship" in his sunset years card...

But yeah, he's nuts to roll the dice.

Actually, no. The Sixth Amendment to the Constitution is quite clear: “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury...”.

Please note the word “all”.

But wait. In 1970 the Supreme Court ruled that “all” doesn’t mean all. It only means for offenses carrying a penalty of six months or more imprisonment.

That was a terrible and disgusting ruling. Quite against the plain wording of the Sixth Amendment.

No matter. So if a DA really wants to railroad you, all he need do is charge you with a “minor” crime. Then find a pliable judge. No jury for you. Your sentence: Six months in the county jail.

I’m not too sure.

HOW long did they run this surveillance?

It took them HOW LONG to establish who the players were and what they were doing?

And only AFTER how long they got a big enough fish did they reel it in?

Can Kraft’s lawyers call into evidence, every single one of the videos and call in every one involved to testify?

There may be some GOV officials that may not like that idea.
