Americans have a right to a trial by a jury of our peers, do we not?
Sounds like he is trying to scare off the prosecutors by turning this into a daily three-ring media circus.
Yes, but he should have taken the deal.
A trail will be even more embarrassing...................
> Americans have a right to a trial by a jury of our peers, do we not? <
Actually, no. The Sixth Amendment to the Constitution is quite clear: “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury...”.
Please note the word “all”.
But wait. In 1970 the Supreme Court ruled that “all” doesn’t mean all. It only means for offenses carrying a penalty of six months or more imprisonment.
That was a terrible and disgusting ruling. Quite against the plain wording of the Sixth Amendment.
No matter. So if a DA really wants to railroad you, all he need do is charge you with a “minor” crime. Then find a pliable judge. No jury for you. Your sentence: Six months in the county jail.
