ABC, CBS Stick to Family-Ordered Autopsy in Sacramento Police Shooting

Over the weekend, in the aftermath of the decision not to charge two police officers who shot vandalism suspect Stephon Clark a year ago in Sacramento, ABC and CBS cited the family-ordered second autopsy claiming Clark was mostly shot in the back without mentioning the state autopsy which disagreed.

But the autopsy performed by Sacramento county contradicted the findings of the second autopsy, concluding that half the shots hit Clark in the side as he moved toward police.

At the time, even the left-wing Mother Jones suggested that the county autopsy had a better chance of being accurate because it was conducted first, even though the findings were not made public until after the second autopsy's results had already been announced.

All anyone has to do is watch the officers’ body cam videos and the overhead helicopter infrared video to understand what happened here. It was dark, he was a prowler and he moved toward the officers in the dark after they began shouting at him.

Go to 30:00 in this D.A. press conference video and watch for a couple of minutes.

If this is the case where the man had a cell phone and the cop yells gun, gun, gun, they had zero reason to shoot. The police were clearly not sure of a threat because there was none. This is manslaughter by any definition. Any civilian would be charged with murder. More people will die if the police are not held to the same standard as anyone else.

Are you familiar with the case?

First of all, Clark was pimping out the mother of his children and had put her head through a wall two days earlier. Secondly, he was on a shocking amount of drugs. BAC of .91, weed, Xanax, cocaine, codeine, Benadryl, and about 5 other things.

There are videos from the officers’ body cameras and the helicopter that clearly show a man breaking things and hopping fences before running away from officers into a dark back yard. The officers came around the corner of the house and saw Clark holding something in front of his body and advancing towards them. They told him to surrender and he said “F*** you.” Then one of the officers saw a gleam and mistook it for a muzzle flash.

Don’t listen to what Black Lives Matter is saying about this case. Clark was a horrible person who committed suicide by cop, and his family is better off with him dead.

His DNA was on the car windows he was breaking and he was on parole, two other things they fail to mention.

Im not saying he was a good guy. The police are not judge jury and executioner. I can name a half dozen more cases off the top of my head where completely innocent people have been killed because they “reached towards their pants”, they “made a threatening move” or “ the officer thought he saw a gun”. This guy, bad dude or not deserved his day in court. Do we give the death penalty for what he was accused of? Again, would a civilian be charged? The answer to both is obvious. We can’t allow the police to kill poeple who are not immediate threats to others. There can be no exceptions.

Watch the video.

They were in a dark backyard. The criminal had already thrown a brick through an old man’s sliding glass door. When police arrived on the scene he fled through several backyards, he knew he was being pursued. When the police yelled at him to show his hands he advanced toward them in the dark shadows of an unlit backyard. There was a flash of light from the man’s hands and the officers fired to protect themselves. There was no other reasonable course of action the officers could have taken.

Again, watch the video and review the facts.

I’ve seen the facts and they 100 percent prove this shooting was not justified. This man can’t be brought back to life. None of this would EVER warrant the death penalty. If you were CCW holder and shot this man under the exact same circumstances you would be headed to prison. Try using “it was dark” as a defense in court.

Lethal force is justified only if there is immediate threat to the lives and safety of others. That was not present in this case as can be clearly seen on the video.

BAC of .91 on its own would not seem particularly significant. 1.0 used to be the limit for DWI in many (most?) states until it was lowered to 0.8.

But I am curious what druggies do with Benadryl - I thought it causes sleepiness.

You were so very, very sure that the officers were going to be criminally charged in this. You said it was open and shut. You even said that you were going to bookmark this after I told you that your understanding of the law here was wrong.

Well. Well. Well.

You really should quit playing lawyer on the internet.

The standard is reasonableness, not certainty. No one, NO ONE, CCW holder or otherwise, needs to wait to be staring down the barrel of a gun before they are justified in shooting.

If your internet lawyers told you otherwise, you need to stop carrying, because waiting that long will likely get you dead.

“There was a flash of light from his hands”. You’ve got to be kidding. Flash of light but NO SOUND of shots fired from a few yards away? Is this the he could have had a completly silent silencer on his weapon defense? This is simply the justice system letting the police off the hook yet again. As I’ve said before no civilian would ever get away with this shooting.

What disturbs me most about these cases is so many people have been brainwashed to think this is ok. It’s not.
