Saying they dont believe the legislation is constitutional, some sheriffs in Washington are rebelling against a new state gun law.
The law delivers an omnibus assortment of restrictions for gun owners, Fox News reported Monday. Both the National Rifle Association (NRA) and the Second Amendment Foundation (SAF) say it is unconstitutional and have initiated a federal lawsuit against the state.
The sheriffs in a dozen rural counties say they will not recognize the law until the courts rule on its legality. At least one police chief has publicly condemned the legislation and refused to enforce it.
Washington voters passed the initiative during last Novembers midterm elections. It increases the legal age for purchasing a semi-automatic firearm to 21 from 18, mandates successful completion of a gun safety course before purchasing a gun, and includes a comprehensive and probing background investigation. The NRA and SAF are focusing on the laws age-limit increase in their legal challenge.

If you want to keep your state gun seller’s permit you will obey them. The coercive power of the state is a pretty difficult burden to overcome. So the sheriffs may not enforce the law against offenders, the store owners who have to file the paperwork will prevent new owners of semi-autos who don’t meet the requirements.
When liberals fight laws they don’t like they first shop for a judge to get an injunction to stop the law while it is litigated. Why can’t we?

If I recall, that very sort of demand didn't protect the Nazis at the Nuremberg War Crimes Trials.
Power is the great evil with which we are contending. We have divided power between three branches of government and erected checks and balances to prevent abuse of power. However, where is the check on the power of the judiciary? If we fail to check the power of the judiciary, I predict that we will eventually live under judicial tyranny.

2nd amendment sanctuary counties.
It sounds like they have a few sanctuary counties and cities.

The check on the judiciary is in the Congress. Congress can abolish any Federal court except the Supreme court, but even there they can set the number of seats on the Supreme court and impeach and remove any justice. They may impeach any Federal judge. They can set or zero out their budget. The executive branch can refuse to enforce any of their rulings as long as Congress is not 2/3rds offended by that move. Congress can over-ride a Supreme court ruling by working to amend the constitution on an issue the Supremes did not agree with. The Courts cannot rule an Amendment unconstitutional.
The problem isn”t that there are no checks on the Judiciary. It is that nobody cares enough to use them.
Good points, on paper. However, I wouldn’t say NOBODY cares to use or enforce them. I’d say we are so factionalized that those checks are non-starters.
But as it pertains to congressional leadership, and to you final point, nobody seems willing (due to self centered agendas) to expend the political capital to effectively pursue these checks.
Therefore, we do effectively have judicial tyranny.
Exactly - they ignore constitutional laws and expect folks to follow their illegal whims.
