A national emergency declaration by President Donald Trump over border security could wind up hurting Republicans, GOP Sen. Marco Rubio told CNBC on Wednesday.
The Florida Republican contended that Trump was elected on the promise of building a wall along the U.S.-Mexico border and the president has to keep that promise. But we have to be careful about endorsing broad uses of executive power, he added. Im not prepared to endorse that right now.
Such a declaration would set a precedent, Rubio said. If today, the national emergency is border security ... tomorrow the national emergency might be climate change. Declaring a national emergency, which would certainly face legal hurdles, could give Trump the ability to use the military to build the wall instead of getting Congress to approve the funding for it.

Some Democrat will probably do that anyway. So we might as well build a wall, and then make sure a Democrat never gets elected as President ever again.

I suppose the President could do that but it would make no sense, as there would have to be a specific event the President is acting on like protecting citizens against an approaching Cat 6 hurricane, which I suppose he could claim is theoretically caused by climate change, but it would have to be an event he could directly respond to. The code of the law as written authorizes specific actions to protect citizens against specific imminent or already occurring dangerous events or threats. So to declare an emergency there would have to be a specific and imminent catastrophic climate event that the President can directly respond to in order to protect citizens, and not some unproven hypothetical future climate change event that may or may not even happen.

Ive learned you have to do what you have to do and let the chis fall where they may. If the Democrats want to pull any future stunts, we fight them like hell and hope for the best. The biggest problem with conservatives is we dont fight with everything weve got when we know we are absolutely right!

Trumps response to the emergency: Build a Wall
But all Democrat actions, because theyre so painful and tyrannical, cant exist in one simple presidential action. Their responses always must be hidden in Kafkaesque legislation or murky judicial rulings.
BUT, they will try. The next Dem president will try a comprehensive 10,000 page EO so complex that the Trump-infused Supreme Court cant possibly allow it.
Rubio wants to make a deal with President Trump to get amnesty for the dreamers, in exchange for a small amount of wall funding. In a national emergency there is no need to make any deals. We build a wall, and the dreamers can be sent back to the sh**hole countries they came from.
Ok, so lemme see if I have this straight: The Dems, who routinely dismiss law to serve themselves might dismiss the law to serve themselves?
