Supreme Court rejects Trump plea (5-4 Roberts joins the liberals) to enforce asylum ban

he Supreme Court won’t let the Trump administration begin enforcing a ban on asylum for any immigrants who illegally cross the U.S.-Mexico border.

New Justice Brett Kavanaugh and three other conservative justices sided with the administration.

The court’s order Friday leaves in place lower court rulings that blocked President Donald Trump’s proclamation in November automatically denying asylum to people who enter the country from Mexico without going through official border crossings.

Trump said he was acting in response to caravans of migrants making their way to the border.

The administration had also complained that the nationwide order preventing the policy from taking effect was too broad.

But Chief Justice John Roberts and the court’s four more liberal justices rejected the administration’s suggestion for narrowing it.

Ginsburg’s “lung” cancer is almost certainly metastasized from her pancreatic cancer. She has no risk factors for developing cancer in her lungs ab initio.

saw this today- we supposedly have laws against people coming into our country ILLEGALLY, but roberts thinks the laws shouldn’t be enforced?

The immigration laws, as passed by Congress, explicitly say that an alien can apply for asylum whether they entered legally or illegally.

U.S. Code Title 8, Chapter 12, Subchapter II, Part I § 1158

"Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title."

roberts strikes ma as a petty man. this was probably an act of revenge on his part. To hell with the country as long as he can get his little sick in. There are literally 1000s coming across the boarder illegally every day. We don’t hsve the infrastructure to handle a 10th of that, yet the black robed tyrants wont allow anyone to do anything about it. In a sane world, the congress would put an end to this.

He’s bypassing the courts and supreme’s by dealing directly with the leadership of countries.

Yes, that deal with Mexico kind of made this decision moot. Is Roberts going to tell Mexico they can't do that?

“The high court action followed a ruling Wednesday by U.S. District Judge Jon Tigar that kept the ban on hold pending the outcome of a lawsuit challenging it. The case could take months to resolve.” Convenient of AP to leave that fact out before the update. Just have to hope to be able to flip Roberts in the actual arguments.

Ginsburg voted from the OR?

The vote is taken long before the opinion is released. After the vote, the Majority opinion is assigned and written and the Minority opinion or opinions are written. Votes can change during that period, but it rarely occurs.
