Judge Sullivan told Flynn:

“You were an unregistered agent of a foreign country while serving as the National Security Adviser to the President! “Arguably, this undermines everything this flag over here stands for! Arguably, you sold your country out!”

No, if Flynn withdraws his plea the judge may toss the case out.

However, yes I have years of pessimism when it comes to the “politics” of our elected representatives.

Most conservative legal pundits I’ve read have said that law would never stand up to constitutional scrutiny.

Would why the Logan Act be struck down?

1. The language of the law is very broad and vague.

2. The U.S. government itself is often involved with multiple parties in foreign dealings, so "U.S. interests" are not always clearly defined.

3. In many cases it's almost impossible to define "any disputes or controversies with the United States" (the language of the law) in a way that passes muster in a criminal proceeding.

In the Flynn case, for example, he's accused of asking the Russians to veto a UN resolution on Israeli settlements in East Jerusalem because the Obama administration would not veto it. This should have disqualified Flynn from any consideration even to work as a janitor in the White House, but how would it be illegal? What exactly was the dispute or controversy of a foreign nation with the United States here?

Read defense atty Robert Barnes’s twitter thread.

Apparently he was trying to get Flynn to fish or cut bait. Flynn, on the other hand, was trying to get Sullivan to do all the heavy lifting. It takes a lot, according to Barnes, to even get a PRO-defense judge to overrule a plea deal. Flynn’s defense team could have outlined malfeasance (carefully) in their plea.

You can’t expect the judge to do all the work for you, especially if he’s willing to let you go.

We all know what Cankles did.

But that does NOT take the onus off of Flynn for having to fight the enforced plea. If he won’t, Sullivan can’t rescue him from BOTH the prosecution and the defense.

If Flynn withdraws his plea then he would have to take his chances with a D.C. jury. Trump got 4% of the vote in D.C. Think of the jury pool. Flynn’s plea arrangement sentencing recommendation from Mueller is ok with probation-only, no jail time. A jury might not go along with that.

He could have elected to go with a judge alone. The Mueller thugs used lying to the FBI as a pretext to get Flynn’s early cooperation while they continued to hang over his head the failure to register as a lobbyist for Turkey if he did not plead out to the lying charge. Now they have Flynn in a box where he will have to manufacture testimony against Flynn’s associates, who they just charged yesterday. It’s the only way Flynn is going to stay out of jail at this point. Sullivan just blew my mind with respect to his one-sided approach in labeling Flynn a traitor while he gave a pass to the Mueller thugs who had been playing 302 deceptive games with him. Where in the hell did Sullivan come up with this traitor characterization for Flynn? Sullivan was so off the wall and outrageous it is unforgivable. Now, this crazy situation continues until March.

The Clinton-appointed judge, Emmett Sullivan, claimed that Flynn’s suggestion that the FBI misled him (which it, you know, did) cast doubt on Flynn’s acceptance of culpability. The not-so-veiled threat from the judge is that if Flynn wouldn’t repudiate his previous complaints about the FBI, he’d toss out the plea deal and sentence Flynn more harshly than the plea called for.

He also badgered both Flynn and the prosecutor about whether Flynn had committed “treason.”

Though then, after he returned from a break, this Clinton appointee said he wanted to “clarify” that his own previous claim that Flynn was working in the White House when his contacts with foreigners occurred. I guess he bothered to read the actual facts and corrected himself — well, “clarified” — that Flynn wasn’t in the White House and that he was now not “suggesting” treason.

Which is actually exactly what he did before.

Basically the judge seems to be threatening Flynn with jail time unless he offers more to the Mueller investigation. Flynn has gotten that message, and now says he wants to delay sentencing because he might cooperate more with Mueller.

The court has delayed sentencing to permit this. So, no sentencing today. After threatening Flynn for an hour, Flynn got the message and said he would cooperate more.

Mueller’s sentencing recommendation for General Flynn was complementary. Mueller said Flynn cooperated fully, that his military service should be honored and that Mueller was fine with no prison time.
Flynn should have been sentenced today to probation or a fine but it looks like his lawyers made a tactical error that pissed off the judge.
The judge asked Flynn multiple times if he wanted to withdraw his guilty plea and every time Flynn said no.

‘BTW’, yes I am VERY pessimistic! If you have been paying close attention, the FBI under Comey (who signed off on the fake/fraudulent dossier) forwarded along a huge lie, which was used then to institute the entire Mueller clean up.

There is no trial if you plead guilty. There is only a sentencing upon a plea or verdict of guilty.

What I believe the judge’s quote is in reference to is not any charge about “lying to the FBI”, to which Flynn pled guilty, which, it seems, even Sullivan does not believe is true, but to other charges of Flynn having dual roles as an unregistered foreign agent fot Trukey (seeking Gulan’s extradition from the U.S.) while he was already national security advisor designate on Trump’s transition team.

I am not sure (havn’t kept up) but I believe Flynn’s claim on that foreign agent role was that while a company he was part of did have that role at the time, he personally was not active in that role.

What the judge believes is that the only reason Flynn pled guilty to the “lying to the FBI charge” was so the Mueller team would not investigate him further on the foreign agent charge, which Mueller offered only to see what “help” Flynn would be in Mueller’s witch hunt on Trump.

After destroying Flynn, Mueller was willing to let Flynn off with no prison time, provided he did not contest the charge of lying. Mueller knew that a full-blown trial would disclose all sorts of FBI and SC improprieties. To ensure Flynn would not back out of the deal, the agreement likely threatened Flynn with father prosecution if he did not plead guilty to the lying charge. The bizarre refusal by Flynn of the Judge’s offer likely dumbfounded and ticked off Sullivan who then started intimidating Flynn with all sorts of accusations. Flynn’s stupid lawyer wasn’t smart enough to see what was going on and how hanging with the Mueller thugs was putting his client in further jeopardy. Now all bets are off and Flynn will likely get royally screwed before this crazy case is over.

That is irrelevant.

What is relevant is that the Obama administration used secretive Federal power to illegally target and destroy a member of an incoming administration.

He may have committed crimes. The IC committed multiple crimes to ensnare him.

The judge knows this. He cares more about Flynn’s crimes than about the crimes committed in order to bring Flynn’s ostensible crimes to trial.

Thus dies the Republic.

Michael Flynn is a Lieutenant General. He’s his own man. The words out of his mouth are all that matters.
Judge Sullivan has since ordered Flynn to surrender his passport and remain within 50 miles of the capital.
