Fox' Napolitano Says Trump is an ‘Unindicted Co-Conspirator’: ‘Ample Evidence’ to Indict POTUS (ugh)

Judge Andrew Napolitano says President Trump could face “doomsday” over the various investigations surrounding him.

The Fox News senior judicial analyst gave an interview earlier on Monday in which, he rebuked Rudy Giuliani for saying that Robert Mueller will never be allowed to interview the president. Hours later, he doubled down when he joined Shepard Smith and said Mueller could end up indicting Trump over his most recent legal blow-ups.

“Last week in a federal direct court here in New York City, a federal judge at the end of Michael Cohen‘s sentencing said the president orchestrated and paid for this crime,” Napolitano said.

“So you’re saying he’s an unindicted co-conspirator,” Smith asked.

“Yes,” Napolitano answered. “There’s ample evidence––this doesn’t require too much analysis––to indict the president, the question is do they want to do it. The DOJ has three opinions in this: two say you can’t indict a sitting president, one says you can, but all three address the problem of ‘what do you do when the statute of limitations is about to expire?’ All three agree in that case you indict in secret, keep it sealed and release it the day he gets out of office.”

As Napolitano continued to remark on Giuliani’s effort to turn the public against investigations into Trump, he argued that Giuliani is actually trying to send a message to Mueller about negotiating terms for an interview with Trump. The goal, Napolitano hypothesized, was to help Trump avoid a subpoena or a grand jury environment where he might walk into trouble.

Napolitano’s longtime friend James C. Sheil died on March 19, 2013.[39] In the Acknowledgements section of his book Suicide Pact: The Radical Expansion of Presidential Powers and the Lethal Threat to American Liberty, Napolitano states: “... my happy dreams turned dark last year when Jim Sheil, my alter ego to whose memory this book is dedicated, died suddenly on March 19th 2013, as we were working on this book. Jim and I shared much of our lives with each other. Among that which we shared was a love of the printed word. Yet our philosophies and politics were like oil and water.”[40]

Napolitano has stated that he is not related to former U.S. Secretary of Homeland Security Janet Napolitano, whom he sometimes jokingly calls “Evil Cousin Janet”.[41][42]

Napolitano is a vegetarian.[43]

The phrase “unindicted co-conspirator” is the new shiny object for mass media. I heard the phrase today on KABC 790 radio while driving around. I listened for a few minutes to learn the name of the crazy person on the radio: Dr. Drew.

I will still watch Fox News. It actually has a balance of conservative and liberal voices, plus a few in the middle, as obnoxious as the libs are. Perino (RINO), Gutfeld (leans conservative), was anti-Trump, now supports, Williams (knee-jerk lib apologist, Obama lover), Varney (conservative), Hannity (conservative), Cavuto (leans conservative, never-Trumper), Shemp (biased, ultra-liberal anti-Trumper), Faulkner (leans conservative), Rivera (lib posing as a Trump-friendly Republican)...Can’t remember all the others.

When the FECA was enacted, the Supreme Court had to grapple with the limits that the First Amendment imposes on the FECA, including on the definition of "expenditure." In Buckley v. Valeo, the Supreme Court determined that there had to be some limits placed on what could be considered "for the purposes of influencing" an election and thus determined it could be applied only to electoral statements that urged voters to expressly advocate for or against a candidate. If statements did not have those words of express advocacy – clear statements of support or opposition to named candidates – then they cannot be considered expenditures. Not publishing a story has no content – it cannot contain express advocacy – and thus cannot be an expenditure subject to the FECA.

Furthermore, no federal court has ruled that not influencing an election constitutes influencing an election. The federal government tried that theory once before, when Senator John Edwards had help supporting his mistress to keep his affair quiet and prevent it from hurting his political aspirations. He was charged with four campaign finance violations but was acquitted on one charge, and the other charges were later dropped. Thus, this creative legal theory by the prosecutors has never previously been successfully used against anyone during FECA's 45-plus years in existence.
