Christine Ford characterized her recollection as a “recovered” memory. That means that it was induced under psychoanalysis.A woman who knows that she was abused by a man makes a terribly dangerous witness to that man’s reputation, and a woman with a recovered memory is as certain of her memory as you are of your name.
But the problem with “recovered” memory is that although the patient with a recovered memory is certain of her memory, recovered memories have no necessary relation to historical fact. It is all to do with the process by which the woman "becomes aware” of her memory. If the testimony of a woman with a “recovered” memory will be a devastatingly effective witness - effectively almost becoming the jury - that process is a legitimate subject of scrutiny.
The people who bring forth “recovered” memory testimony are not upfront about that process, and they don’t videotape it. The reality is that you have to assume that that process would be objected to most vociferously if brought into the courtroom.
Note that I am putting the best face on Ford’s testimony; it is not difficult to argue that rather than merely having a faulty memory, she cooked up a story with her friend and was flat-out lying.

This should be sound basis to remove her.

I know of unpublished opinion where three justices agreed with judge that illegal acts are not wrongful in a cause for fraud, despite citation to dictionary.
