Rep. Carlos Curbelo (R-Fla.) on Tuesday slammed President Trump over his stated intention to sign an executive order to stop the practice of birthright citizenship.
"Birthright citizenship is protected by the Constitution, so no @realDonaldTrump you cant end it by executive order," Curbelo tweeted. "What we really need is broad immigration reform that makes our country more secure and reaffirms our wonderful tradition as a nation of immigrants."

Do it. Even if the Judiciary overturns it, it is a poltical battle worth fighting.
Some time in politics having the fight, even if you lose, is better then conceding the field to the enemy.

The 14th Amendment was written in such a way to EXCLUDE from birthright citizenship the children of aliens who were in the land lawfully but ONLY so under their own nation, namely those native Americans who had not gone to reservations or been naturalized ... how is it that it has been applied to the children of aliens who are not in even in the land lawfully to begin with?
There should have never been birthright citizenship for the children of Illegal Aliens, and not for their children either. They must legally enter the country for that. They should all be deported, every last so-called Dreamer included.

What he means by this is amnesty and the abandonment of the rule of law.

If The Constitution meant to say “Anyone born here is a citizen” it would have said “Anyone born here is a citizen”
But it doesn’t.
It has the “AND under the laws and jurisdictions” clause to EXCLUDE law breakers.
Birthright citizenship as it's practiced today is not "protected by the Constitution." The 14th amendment was created to grant former slaves and the children of citizens/legal residents citizenship, because prior to that time there was no clear Constitutional definition of citizenship. The 14th amendment certainly wasn't passed so that illegal invaders can scuttle across the border to give birth with the intent of creating ad hoc citizen anchor babies for the extended family.
When in doubt, look to original intent.

The author of the 14th Amendment Citizenship Clause, Senator Jacob M. Howard, stated, in reference to the Amendment, This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the family of ambassadors, or foreign ministers accredited to the Government of the United States, but will include every other class of persons.
It really dpesnt matter this is the fault of Congress and each one uses it against the other while doing nothing. They all should be voted out.
Ending birthright citizenship only requires minor changes to cfr 515.329 and cfr 515.330.
Google and read them. You will see how simple it can be. It does not require a change to the Constitution.
