The city could pay billions for a test that didn’t really discriminate

It’s just nuts that the city might have to cough up billions for supposedly racist teacher-certification exams it stopped using long ago. But don’t count on Mayor de Blasio to fight it.

To be clear: No one has ever had to show that the Liberal Arts and Sciences Test, aka LAST, was actually discriminatory. “Disparate impact” law makes it necessary to demonstrate only that members of minority groups perform worse on an exam than their peers. And if officials can’t then prove the tests are effective at screening out unqualified would-be employees — a highly subjective measure — well, case closed.

Thus, federal Judge Kimba Wood found that the fact that more than 90 percent of whites passed the LAST, but less than 62 percent of blacks and 55 percent of Hispanics did, was enough to brand it “biased” and hold the city liable...

There is some precedent, but it’s very narrow.

The US DOJ Civil Rights Division could kill such nonsense tomorrow. And Jeff Sessions could order it tonight.

Objective tests of any kind will always have a "disparate impact" on selected gender, ethnic and racial groups. The assertion that talents, skills and abilities are evenly distributed among all sub-populations is simply false.

Everybody has some activities they are better at doing than anybody else. Everybody has some activities they cannot do as well as somebody else.

We can ignore reality. We cannot ignore the consequences of ignoring reality.

I don’t understand this at all. If the test was objective (who was the US president during WW I, what is the charge of an electron, etc.), how can there be any challenge?

Either you know your stuff, or you don’t.

This isn't about "knowing your stuff". It is about an organized political faction attempting to loot the treasury under the fraudulent premise of "racial discrimination" and "disparate impact".

Past time to kick people to the curb when they try this sort of thing.

I passed the LAST test with nearly a perfect score. It was, to me, nothing more than a slightly jumped up SAT test. If the blacks and Hispanics are having a hard time, it simply reflects their much more constricted home environment which kept them from widening their horizons. I’ll bet they didn’t have bookshelves lining the living room, with books that were actually read. I’ll bet they didn’t visit museums, zoos, etc. as a kid. I’ll bet they weren’t reading before they entered kindergarten, as I was. Nor did they seek to expand their horizons on their own, as in undergrad days. I find their excuses for “redoing the LAST exam” feeble and pathetic. I found most black and Hispanic teachers I met—with a few exceptions, of course—to be people without a broad educational background. They didn’t know from Shakespeare, they tended to believe stuff without checking it out, they tended to act on emotions rather than logic (hence the success of grifters like Al Sharpton), they didn’t know from geography unless it was their “home country”, they were not lifelong learners, and they had an inferior grasp of their subject matter. Whether you were born here in a lower socioeconomic environment or whether you emigrated to this country to live and work here, it is your obligation to make up any “cultural deficiencies” which might affect formal test scores. It is not MY obligation, as a taxpayer, to pay big time for tests to be revamped until they are at a level low enough for you to pass. I’m tired of minorities making every and any excuse for themselves as to why they can’t succeed. Having some minority friends who have towering intellects, are extremely well-versed in many subjects, and are very work oriented, I am convinced it is totally possible—if you are sufficiently motivated—to pass standardized tests without their having to be dumbed down. And isn’t having to have the tests revamped a form of calling yourself dumb?

The only possible reason why members of a particular group do poorly on an exam is because Evil Whites are at fault.

And a lot of them are doubling down on it by indicating that black and Hispanic children should only have to read "culturally relevant" literature - most of which was written in the last 50 years, is at the 5th grade lexile level, and is little more than a litany of complaints about all the bad things that have happened in their lives.

When I used to frequent mega bookstores a few years back, I would check out what interesting people were reading by watching which book sections they stopped to browse in. At that time I observed that the overwhelming majority of black people would stop in the black interest section of the bookstore. This is just a statement of fact, or an observation. It is like that was their main interest. Of course there were exceptions.
