Judge dismisses all charges against 3 [update: 5] 'extremist Muslim' New Mexico compound suspects

Judge Jeff McElroy on Wednesday dismissed all of the charges against three of the five defendants arrested in connection to a New Mexico compound linked to “extremist Muslims” because authorities violated the state’s “10-day rule.”

Plus they razzed the compound and the Sheriff put out some statement that would have been used by the defense. WAAY higher people are pulling the strings here.

NEWS like this, for anyone who cares, and is watching will only secure the election of Republicans can want to go after and cean up the Judiciary banch of government. This ruling is for sure JUDICIAL LEGISLATION from the Bench.

A mental disorder like Same-Sex Attraction Disorder cannot be compartmentalized. It does, and always will, slop over to contaminate the rest of a person’s thinking.

No one who suffers from SSAD should have *any* position of responsibility.

You can go back and check my history here since 2001. I have preached against the lies of the fake two-party system the whole time. If I defend the GOP, it is simply because it is the lesser of two evils, but I would choose an alternative to the two if there was a serious contender. I have repeatedly suggested that we should lobby for a third party that politicians on both sides of the aisle (mostly early-Obama days before ALL the Democrats when full moonbat) can join after leaving the fake two-party system. When Trump began to rise in 2016, I was an early adopter. When the GOP NeverTrumpers right here on FR started fighting against him, I defended him simply because he was exposing the UniParty at every level from Main St to Wall St to K Street and from Congress to your neighbor’s kitchen.

What happened to wanting judges who follow the law as written? It sounds like this judge had no discretion under the law. Blame the legislators who passed the law, and the idiot DA who ignored it. The DA needs to get this before a grand jury and re-indict right now.

It appears he ruled on the procedure (the prosecution didn’t arraigned the suspects within 10 days of arrest.) not the crime.

Sounds like the Judge was following the law.

The question is who are those involved in the prosecution who screwed this up and was it on purpose?

Part of this is the media’s fault for not explaining what the “10 day rule” is.

There is a valid reason for the rule. It’s to ensure that people are not held in custody by the government for a lengthy period of time without the chance for a preliminary hearing to determine if there is probable cause to certify the case.

The DA screwed this up. 5-302 makes clear that dismissal is without prejudice, that means that the case can be refiled.

This is not a double-jeopardy situation. It’s purely procedural. NM Rule 5-302 makes clear that the dismissal is without prejudice. The charges can be brought again.
