Judge Jeff McElroy on Wednesday dismissed all of the charges against three of the five defendants arrested in connection to a New Mexico compound linked to extremist Muslims because authorities violated the states 10-day rule.

I looked it up and it appears the 10-day rule is that the suspect has to be arraigned within 10 days of arrest. I guess they weren’t.
Did the County Attorney deliberately crab this case? If not, who? Why? This is effin stupid.
Yup, The ‘10 day rule’ ( which the Lefty Judge just pulled out of his ass) means that Mudslimes that aren’t tried and convicted within 10 days have to be set free.
So, not because they weren’t guilty, but because the Feds violated some rule. So when those 3 k=go on a killing spree, this judge should be arrested for murder.

The casecan easily be refiled, usually while they are still in jail
Whoever dropped the ball on this one should be charged with their crimes.

I argued with some guy on FR last week about the coming civil war. He claimed to love the rule of law too much to rebel against the government or to fight the people who have subverted our Republic into mob rule. I said that we no longer operate under the rule of law in this country since there is selective enforcement, selective prosecution, political implications color legal decisions, etc. The rule of law died during Obama.
The fact that judges are bending over backwards to make these terrorist training camp cases go away is the final evidence.

istrict Judge Emilio Chavez made the decision just after noon Wednesday in regards to Lucas Morten, Hujrah Wahhaj, and Subhannah Wahhaj saying the prosecution failed to indict them within ten days of their first appearance in court.
Judge Chavez noted that the state can re-file charges based on new information at a later date.
Does double jeopardy apply when a judge does this? Do they really just have to “start again”?
