Fox News legal analyst Andrew Napolitano said Thursday that Deputy Attorney General Rod Rosenstein's alleged ethical violations are not impeachable offenses.
Improperly signing off on a [Foreign Intelligence Surveillance Act] warrant, staying in a position of a conflict of interest where you could be a witness in a case and youre managing the case those are good arguments for ethical violations but not impeachable offenses, Napolitano said on Fox News's "Fox & Friends."
The former judge discussed the articles of impeachment introduced by a group of conservative House lawmakers late Wednesday against Rosenstein, the top Justice Department official overseeing special counsel Robert Muellers Russia investigation.
Rep. Mark Meadows (R-N.C.), the head of the House Freedom Caucus, and 10 co-sponsors introduced five articles of impeachment shortly after meeting with Justice officials.
The lawmakers accuse Rosenstein of having a conflict of interest in Muellers investigation because he could be called as a witness in the ongoing probe into potential surveillance abuse against former Trump campaign adviser Carter Page. Rosenstein signed off on the FBI surveillance renewal application to wiretap Page.
Napolitano said Thursday he often agrees with the small group of conservative lawmakers.
On this, I profoundly disagree with them, Napolitano added. It doesnt matter what I think. The Constitution says theres a very, very narrow basis for impeachment and thats intentional.
Treason this is directly from the Constitution bribery or other high crimes and misdemeanors, Napolitano added.
Democrats said on Wednesday that there is no chance that Rosenstein would be forcibly removed, calling the articles of impeachment a direct attack on the special counsels investigation.
"It is a panicked and dangerous attempt to undermine an ongoing criminal investigation in an effort to protect President Trump as the walls are closing in around him and his associates," said Reps. Jerrold Nadler (N.Y.), Elijah Cummings (D-Md.) and Adam Schiff (Calif.), top Democrats on the House Judiciary, Oversight and Government Reform, and Intelligence committees, respectively, in a joint statement.
"It is certainly not, as its sponsors claim, a principled attempt to conduct oversight of the Department of Justice, because House Republicans have refused to conduct oversight of any aspect of the Trump Administration, except where the inquiry might distract from their failed agenda, undermine law enforcement, and serve the interests of President Trump," they added.
Somebody told him what they have on him.
“If trump did his job none of this congressional posturing would be necessary”
If people like you did yours, congress wouldn’t be threatening him if he did.
But it’s easier to complain online, right?
Now replace Deputy Attorney General Rod Rosenstein's name with President Trumps name and see how that sounds...
But did he laugh while saying that?
It took 20 years for President Trump to expose the Mittlickers in the Media as partisan Democrats who were stealthily defending Rapin Bill the whole time they were pretending to be "objective".
Napolitano pulling his punches could be similar to a George Will trick.
her is where you argument is ridiculous. We know what trump isn’t doing. however you know nothing about me, but you make things up to deflect from the accuracy of my point.
When you recognize trump’s responsibilities, you will see why you are protecting the indefensible. get yourself educated and stop attacking people who make accurate points.
Sedition, bribery, pedophilia protection, racketeering...
Napolitano is wrong.
Takes balls to do your job sometimes. As i said let congress take their shot when he fire them for failing to respond to congress. Bring articles of impeachment before an election. Idiotic in the face of it. He can let sessions and RR continue this way for 7 years or clean up the mess. But if he let’s congress strong arm him, he should resign now. You see how idiotic that is?
Yes, Congress has ultimate oversight of Rosenstein and DOJ. Congress could disband DOJ and FBI in an afternoon if they so choose. The President and the Supreme court would be powerless to stop them.
I was referring to the means for congress to impeach Trump. But I can see why you thought I meant rosenwiezel.
Recused himself, NapolitanoIdiot, RECUSED himself given RosensteinIdiot is apart of the case being investigated!!
Napolitano hasn’t been right for a long time.
“We know what trump isnt doing.”
And you know why he isnt. It’s been discussed 100000000 times over. Only ones that dont get it by now are wilful liars or idiots. Pick one.
My point is STILL accurate.
Now continue to bitch and posture online. Like I said, it’s easier.
He is withholding information that Congress is legally allowed to see for the purpose of obstruction....end of story.
and you’re not posturing and bitching? When you admit you are blindly defending him on this issue, you will start the healing process. get over your self righteousness. The louder you complain and accuse the more we realize you can’t denfend what is doing.
Help yourself He asked for the job, I didn’t. I had my time in the fishtanks.
Alright then, you just keep nipping at Trump’s ankles.
“and youre not posturing and bitching?”
Nope. Thanks for asking.
“When you admit you are blindly defending him on this issue”
Reality and facts =/= blindly.
” The louder you complain and accuse...blah blah blah”.
Still have yet to hear where I’m lying. Just that you dont like the truth.
