Less than a day after President Trump announced Judge Brett Kavanaugh as his choice to fill the vacancy left by Justice Anthony Kennedy on the Supreme Court, Todd Starnes spoke with Alan Dershowitz, Harvard Law Professor and author of The Case Against Impeaching Trump, about why Judge Amy Coney Barrett was not selected.
"I don't think the President decided not to pick Barrett, I think he decided to not to pick her for this vacancy. I think he anticipates several vacancies. If Ruth Bader Ginsberg leaves, he might pick her then. The American people have to know one thing that distinguishes these two. I think that, very likely, Kavanaugh will cut back on Roe Vs. Wade. I think he thinks it was wrongly decided, that it should be left to the states. Barrett may have a very different view. She believes that there is a right to life that the fetus is an innocent citizen of this country. And basically, maybe she believes, that states don't even have a right to permit abortion. Most Americans won't support that," Dershowitz said....

the reason Dershowitz is not attacking trump is that he thinks if he plays nicely and argues that the president cant be impeached that he wont be prosecuted for his crimes that he did on Epstein Island. he is not a friend he is rat on a rat infested ship and unlike the rest of the rats he is smart enough to be the first rat to leave a sinking ship. watch closely and you will see more and more rats either flee or try and be helpful so they are not prosecuted.

Scalia never said anything I know of about canabalism (thouhg he may have). But you can find what his thoughts on Roe were. My point is not any moral argument, just acknowledgement of what I have understood about Scalia’s view on Roe. I think you will have a hard time asking him about cannablism now.
If a State starts a suit to limit or abolish Abortion the fuse is lit, and it goes to SCOTUS and then we are getting somewhere!
I heard Dershowitz. He believes there are three main views on abortion — status quo, leave it to the states, and outlaw it nationwide. I don’t see “outlaw it nationwide” happening.
Dershowitz is a smart man and is usually worth a listen. He is not always right but he is not your typical blind democrat partisan either.
Trump is smart too. He needs to manage his political capital wisely to ensure he gets elected again so he can get one, two or more SC justices confirmed. Of course that only happens if Republicans keep the Senate. Without the Senate Trump will not get any more SC justices approved -— period. It will stay 4-4 until he is gone.

Don’t the justices have to be physically present during arguments before the Court?
It’s one thing for RBG, for example, to fall asleep during Court sessions, but it would be another thing if she were in a coma and had to be carried in and out of the courtroom on a stretcher by EMT personnel.

Just to clarify: By “federal matter”, I did not mean the Supreme Court to come down and legislate from the bench in favor of abortion.
The Guarantee Clause affirms the federal government’s obligation to “guarantee to the states a republican form of government”, and any state that votes to legalize abortion has abandoned that form of government. Not to mention, the powers reserved to the people have to be considered with respect to the powers reserved to the states.

Hes right. Except that I dont think Barrett will vote to make abortion illegal under the Constitution. Even before Roe it was a state law issue, not a Constitutional issue.

Dershowitz voted for Hillary Clinton and donated to her campaign, he proudly admits. Just another Democrat fool, no matter what his diplomas say.
Dersh may be on to something.
Currently, a majority of Americans don’t have the moral imagination to imagine life without abortion. Allowing states to permit it will be a legal regime that they cab accept.
But once Roe is overturned, and abortion made generally illegal in some states, and once people see that the sky doesn’t cave in, then maybe the majority will see that all innocent persons, born and unborn, must be protected in law from homicide. Then, the Court could rule that the right to life of unborn persons is inherent on the Constitution, and by then, most folks will be able to accept it.
After awhile we’ll have much less need for immigration since we’re letting our babies live and grow up into productive people.
