I agree. I was pulling for Barrett, but no way she’d get confirmed with such a slim R majority.

Wait until after 2018 and RBG’s inevitable passing or retiring and she’ll be a shoe-in.

This thread is irrefutable evidence that a lot of Freepers will b!tch and complain about anything.

It's really surprising Trump is even there to nominate this guy. If he had listened to a lot of folks here, he would have dropped out of the 2016 campaign on about two dozen different occasions.

But his mother later went to law school and became a prosecutor, so that’s a point in her favor, at least for me.

He sounds like a very good man who will uphold the Constitution and the rule of law. As others have observed, it could have been a whole lot worse if the other candidate had won the election in 2016. A whole lot worse.

Reading all of the comments on this thread, I suspect that quite a few of the participants will be joining the loonie lefties on the steps of the Supreme Court. I don’t think that you are going to like that crowd.

That’s the whole thing about Dem/Libs. They will scream that it is a woman’s right to yadadadadada. Yep, I agree, the decision to get pregnant rests solely upon the woman. If you decide to open your legs, you are the only one that can make sure you do not get pregnant. It is as simple as that.

MANY, MANY Catholics are also PRO immigration, I understand Kavanaugh is pro life HOWEVER I still view him as a SWAMP CREATURE!!! MAYBE he will NOT be seated and we will get a NON SWAMP CREATURE!!!!

I think meeting his family is a way of checking the Left before they even start. It highlights something the rabid Left so often disregards completely - the humanity of the worthy opposition.

Bet this guy was 3rd or 4th down Trump’s list, but was a smart strategic decision for now. He will have at least one more and likely more he’ll pick for the SC very shortly, let’s keep that in mind! :)

Here is Ketchledges actual decision in PATEL v UNITED STATES CITIZENSHIP ANDIMMIGRATION SERVICES

Here is what Ketledge wrote:

Patel filed suit in federal district court under the Administrative Procedure Act, challenging the denial [of an employment petition] as arbitrary and capricious. The district court dismissed the suit for lack of prudential standing. We reverse.

IOW the district court held that Patel did not have standing to seek judicial review of an administrative decision by USCIS. Kethledge holds that Patel does have standing to seek judicial review.

As Kethledge wrote: in enacting the Administrative Procedure Act, Congress intended to “make agency action presumptively reviewable.” ... Thus, a plaintiff lacks prudential standing only if his “interests are so marginally related to or inconsistent with the purposes implicit in the statute that it cannot reasonably be assumed that Congress intended to permit the suit.”

...[excerpting a lot more well-written argument] Kethledge concludes:

Disembodied notions of statutory purpose cannot override what the statute actually says. What § 1153(b)(3) says is that the alien, ultimately, is the one who is entitled to the employment visa. The alien’s interest in receiving it is therefore within the zone of interests protected or regulated by the statute. Patel has prudential standing to challenge the denial of his prospective employer’s petition for an employment visa.

Of course the Administrative State would like for its determinations not to be judicially reviewable. But that is tyranny. This is a blow for rule of law, not open boarders laissez faire immigration like Anne and Breitbart claim.

Kavanaugh sits on the DC Circuit Court. So it’s not a huge surprise President Trump selected a member from it.

Kavanaugh worked as associate counsel to pro-life President George W. Bush and he came out of the era of Reagan judicial appointees. His rulings have been said to be more like Scalia than Kennedy, however.

Sarah Pitlyk, a former law clerk to Judge Kavanaugh and special counsel for the Thomas More Society, which is a leading pro-life legal group, says Kavanaugh has an excellent record and perhaps the best record of any of the finalists president Trump is considering. As she writes:

On the vital issues of protecting religious liberty and enforcing restrictions on abortion, no court-of-appeals judge in the nation has a stronger, more consistent record than Judge Brett Kavanaugh. On these issues, as on so many others, he has fought for his principles and stood firm against pressure. He would do the same on the Supreme Court.

The pro-life attorney is not the only Kavanaugh fan. As Newsmax reports, Ed Meese is a huge supporter.

Ed Meese, President Reagan’s Attorney General and one of his closest associates, has known Kavanaugh for decades and confirmed he has been a solid Reaganite as a judge.

“I know Brett Kavanaugh reasonably well and think highly of him,” Meese told Newsmax.

“He is a very able guy, an originalist who is faithful to the Constitution and believes in it.”
