In WA state, the WA Supreme Court ruled that the Legislature was not spending enough money on Education, and would fine the body daily until Education was properly funded. This was because the state Constitution says that Education is a primary concern, and must be fully funded. Since Schools used Levys to pay for band, sports, music etc, that was unConstitutional. In short, one branch orders the other what to spend money on, and how much. BOTH are Legislative powers.
Progressives needed judges to overthrow governance by constitutional means while maintaining the pretense that it still remained and now they cannot question their edicts even if they wanted to (not that they do).
Republicans didn’t repeal under Eisenhower when they could, when they could still save the country from lawlessness, and they are often too compromised to resist.
Because the ruling class want it that way.
Legislators encouraged it.
And most legislators have never read the constitution: “The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour . ..”
