If this is the kind of lawyer Harvard is turning out, it could be time to close up shop in Cambridge . . .

CNN legal analyst and Harvard Law alum Areva Martin argued this morning that Stormy Daniels is not bound by her agreement with Michael Cohen not to discuss her alleged affair with Donald Trump, because Trump, per his statement of yesterday, was unaware that Cohen had paid Stormy $130,000.

Martin’s reasoning was so transparently flawed that co-host Alisyn Camerota had no trouble demolishing it:

Yes. Money constitutes “consideration” under the law, and Daniels’ acceptance of it binds her to the promise she made in return not to discuss the alleged affair.

Hopefully the endgame is Mr. Cohen (Trump’s attorney) filing a civil lawsuit against Stormy for breach of contract and a formal complaint to the state bar against the attorney for breach of ethics (i.e. advising his client to break a legal contract and aiding his client in the breaking of the contract by publicly discussing the matters the contract required to be kept quiet).

As to Stormy’s attorney stating he and his client are ready to negotiate a settlement with Trump, there is nothing to settle with Trump. He has denied the Stormy’s allegations. Despite her NDA with Trump’s attorney she has gone public with her story. Having gone public, she no longer has any leverage on Trump. Perhaps she and her attorney are saying they want to settle with Mr. Cohen before he files a breach of contract lawsuit or files charges with the bar against the attorney. There is no upside for Cohen to settle for less than he can realize in court. Stormy has already demonstrated she will willfully violate a NDA and her lawyer clearly will leak to the press. Cohen is better served to sue in court for breach and run up Stormy’s legal bills.

I wondered if this agreement was really for Don Jr. Who coincidentally just separated with his wife. Or if maybe this was for services she provided to the golf/party event where she met Donald? Maybe she was hired for some raunchy striptease at a private party during the event?

She made the deal with his lawyer. He should sue her for breaking it. Wasn’t there an amount in it agreed upon that she owes if she broke it?

He didn’t know therefore had nothing to do with it. Although what I am wondering is who else the lawyer had files on? Anyone found in the files could potentially be blackmailed as well.
