Judge Denies $1 Million Funding in Sanctuary Cities Case

SAN FRANCISCO (CN) – A federal judge on Monday refused to order the Trump Administration to pay California $1 million in delayed law enforcement funding it withheld to punish it for becoming a sanctuary state.

U.S. District Judge William Orrick ruled in an afternoon order that it was too soon to tell which party’s interpretation of laws governing cooperation between state employees and federal immigration authorities would prevail. Because “the amount of money at stake is small compared to the state’s budget,” he concluded, California hadn’t shown it would suffer irreparable harm without the $1 million while the case is adjudicated.

It is about time these little spoiled brats felt the back hand of an adult. They have too long been given the green light to do anything they please no matter how much it might hurt their siblings (the rest of the Nation). Bring it on Mr. President. These fellows need to learn discipline, the sooner the better.

I wouldn’t go so far as calling this judge “good”..

He’s the Obama appointee that:

* lied to the senate about his close association with Planned Parenthood
* blocked the release of videos of Planned Parenthood selling human remains
* blocked Trump from withholding funding from sanctuary cities
* ruled Executive Order 13768 unconstitutional and declared a ‘nationwide injunction’ against its implementation.

§1330. Collection of penalties and expenses

(3)(A) The Secretary of the Treasury shall refund out of the Immigration Enforcement Account to any appropriation the amount paid out of such appropriation for expenses incurred by the Attorney General for activities that enhance enforcement of provisions of this subchapter.

Such activities include—

(i) the identification, investigation, apprehension, detention, and removal of criminal aliens;
(ii) the maintenance and updating of a system to identify and track criminal aliens, deportable aliens, inadmissible aliens, and aliens illegally entering the United States; and

(iii) for the repair, maintenance, or construction on the United States border, in areas experiencing high levels of apprehensions of illegal aliens, of structures to deter illegal entry into the United States.

(B) The amounts which are required to be refunded under subparagraph (A) shall be refunded at least quarterly on the basis of estimates made by the Attorney General of the expenses referred to in subparagraph (A). Proper adjustments shall be made in the amounts subsequently refunded under subparagraph (A) to the extent prior estimates were in excess of, or less than, the amount required to be refunded under subparagraph (A).

(C) The amounts required to be refunded from the Immigration Enforcement Account for fiscal year 1996 and thereafter shall be refunded in accordance with estimates made in the budget request of the Attorney General for those fiscal years. Any proposed changes in the amounts designated in such budget requests shall only be made after notification to the Committees on Appropriations of the House of Representatives and the Senate in accordance with section 605 of Public Law 104–134.

(D) The Attorney General shall prepare and submit annually to the Congress statements of financial condition of the Immigration Enforcement Account, including beginning account balance, revenues, withdrawals, and ending account balance and projection for the ensuing fiscal year.

A HUGE shout out to Texas Congressman John Culberson for this.

He worked tirelessly on getting this set up for a long time.

Little does anyone know that, let alone that LORETTA LYNCH signed off on that !

Perhaps the judge is tiring of the ghetto that’s living on the streets of a once great city. He probably sees it everyday and knows the consequences of California’s do-gooders.
