A man who has spent decades on death row for the kidnapping, torture and murder of a southern Utah student is asking the state's top court to halt his execution.
In a hearing before the Utah Supreme Court on Wednesday, attorneys for Michael Anthony Archuleta argued that he is intellectually disabled. Archuleta is facing execution for the 1988 torture killing of Gordon Church.
Archuleta, now 55, was sentenced to die for the gruesome murder of Church, who was at the time a Southern Utah State College student. Church, 28, was shocked with a car battery, raped with a tire iron and his body dumped in Millard County. Some have suggested the killing was a hate crime because Church had revealed to them he was gay.
Archuleta and Lance Conway Wood, who were both out on parole at the time, were convicted of the crimes. Wood was sentenced to life in prison; Archuleta was sentenced to death.
The Utah Dept. of Corrections has previously told FOX 13 it does not have the chemicals necessary to carry out a lethal injection execution, so firing squad becomes the default method.

Most murderer defense attorneys today claim client is mentally disabled or “temporally” insane. I wonder how many of these clown would use that defense if it was a family member killed?

There’s a name I haven’t seen in quite awhile. Only good thing he seemingly ever did was waive his rights to appeal.
When our family dog was terminally ill, they gave her one shot so the second shot wouldn't hurt. She passed away peacefully in my arms as I cried my eyes out. Easily, and painlessly and effectively. It was a hard thing to do emotionally...but technically it seemed rather simple and straight forward. So why is it so technically difficult for those in charge of administering capital punishment? For myself, I am not sure I could bring myself to take a human life even in cases where they deserve it, and am thankful it is not my job....but as a technical issue it seems it can't be that difficult to do lethal injection right if the vets can do it so easily.
I believe the governor received several hundred requests from volunteers to be on Gary Gilmore’s firing squad. They even offered to bring their own rifles and ammo.
It is a mormon religion belief that some people are so evil they must have their blood shed for redemption. In the pre-Statehood days it was by often by having your throat cut. John D Lee, who was the ONLY man convicted in the Mountain Meadows Massacre was executed by firing squad.

What was the primer that lead to this case?
Because the companies that sell those chemicals used to put your dog to sleep refuse to sell the drug to states for capital punishment (as they are afraid of liberals picketing them, etc.). The state could buy the drug and lie about why, but when the company found out the drugs were used on people, it would probably cease selling anything to the government thereafter, plus the bad PR of the state lying, etc. So, in the end, until a company is found that doesn’t care about the radical libs whining, states are dependent on small supplies from smaller dealers, that are commensurately harder to get and face supply issues. That’s what happens when pharma giants get too many libs in their corporate offices...
