A man who has spent decades on death row for the kidnapping, torture and murder of a southern Utah student is asking the state's top court to halt his execution.
In a hearing before the Utah Supreme Court on Wednesday, attorneys for Michael Anthony Archuleta argued that he is intellectually disabled. Archuleta is facing execution for the 1988 torture killing of Gordon Church.
Archuleta, now 55, was sentenced to die for the gruesome murder of Church, who was at the time a Southern Utah State College student. Church, 28, was shocked with a car battery, raped with a tire iron and his body dumped in Millard County. Some have suggested the killing was a hate crime because Church had revealed to them he was gay.
Archuleta and Lance Conway Wood, who were both out on parole at the time, were convicted of the crimes. Wood was sentenced to life in prison; Archuleta was sentenced to death.
The Utah Dept. of Corrections has previously told FOX 13 it does not have the chemicals necessary to carry out a lethal injection execution, so firing squad becomes the default method.

Why has been allowed to live this long?
Just view it as a different method for lethal injection.
Take a tire iron to him...
What a waste of limited taxpayer resources.
death by copper jacketed lead poisoning...works for me. I think Utah may be only state that still uses firing squad..much more sure than the three drug cocktail

Okay, then. The firing squad shouldn’t shoot him in the head. Aim for the chest instead.
Basic human instinct: Survival.
Utah should allow law abiding citizens the chance to bid for a spot on the firing squad.
What? Ok. We agree. Now "Ready! Aim!....."
If I found myself in a position to have to choose between methods of execution, I would choose firing squad. It’s fast, effective, and has an air of nobility about it that lethal injection does not have.
Viva Christo Rey!
Why can’t they use heroin?...................
Same here. I would fear the injection method because you could get a nasty infection from it.
The drug is called HVL - High Velocity Lead - and it is typically injected straight in to the heart.
Or Drano?
Okay. That’ll be enough of that!
;-)
Too messy.......................
“Lets do it” ......Gary Gilmore
LMAO
Let the festivities begin. You got decades more life than the victim did.
This is what Michael Anthony Archuleta and his partner in crime did to their 28 year old victim:
“The 28-year-old Southern Utah University student was taken by two recent parolees to a remote location in Millard County, where the men attached jumper cables to his testicles, used the car battery to shock him and then sodomized Church with a tire iron to the extent that his liver was pierced. They then beat Church to death with a car jack before burying him in a shallow grave.”
Archuleta is intellectually disabled. And morally disabled. And because of it, he deserves to be shot to death.
