Were just days away from a government shutdown and Democrats are still attempting to write the rules, despite being in the minority.
Back in September, President Trump ended Deferred Action for Childhood Arrivals program from the executive branch and kicked it over to Congress where it belongs.
Congress, get ready to do your job DACA! he tweeted. From the beginning, when President Obama unconstitutionally implemented the program, the protections for those brought into America illegally by their parents were temporary. After all, the D in DACA stands for deferred and the courts ruled the issue cant be implemented solely through an executive order. Every DOJ and DHS lawyer says DACA is unconstitutional. Every other legal scholar right and left says the same thing. Trump didnt end DACA, the law did. That said, I worked and succeeded to give the Congress another six months to do something, White House chief of staff John Kelly said at the time.
Trump isnt a hard-liner on DACA and has repeatedly countered his hardcore base to express sympathy for DACA recipients. Hes made it clear theres always been room on his end for a compromise.
Were working on a plan subject to getting massive border controls. Were working on a plan for DACA. People want to see that happen. You have 800,000 young people brought here, no fault of their own. So were working on a plan. Well see how it works out. Were going to get massive border security as part of that. And I think something can happen, well see what happens, but something will happen, Trump said last fall.
When Trump made the announcement, Republicans quickly jumped into action. Sens. Marco Rubio (R-Fla.) and Jeff Flake (R-Ariz.) demanded a DACA fix be a priority before the sixth month deadline. Before Washington left for Christmas break after passing tax reform, it was reiterated that DACA would be a top priority as soon as lawmakers came back to town.
Republicans were and still are willing to find a DACA fix, so long as border security conditions are met to prevent future amnesties. They know the American people have been here before. Theyve been repeatedly promised security in return for empathy and generosity, while never receiving the former. That isnt going to fly. But rather than use the opportunity on Capitol Hill to help a group of young adults they claim to care about, Democrats are holding the government hostage over their open border, pro-amnesty for all agenda.
Republicans and the White House want three things in return for DACA: a border wall, an end to chain migration and an end to the visa lottery program. This is a fair deal, especially because Democrats have been on board with these measures in the recent past.
In 2006 nearly two-dozen Democrats, including now-Minority Leader Charles Schumer (N.Y.), voted for the Secure Fence Act. It passed with bipartisan support 80-19. The idea was similar to what Trump wants: secure and bolster the southern border with a fence. The wall is simply an upgrade.
Again in 2013, there was bipartisan agreement on the negotiation pieces currently on the table for DACA. The Gang of Eight immigration reform bill, made up of Republicans and Democrats, ended chain migration and the diversity visa lottery program. Schumer was an advocate for the bill, as was fellow Democratic Sen. Dick Durbin (Ill.). Over the years, Democrats have repeatedly voted to expand Border Patrol and to increase the number of Immigration and Customs Enforcement agents. Now that Trumps in charge, theyve run away from all of it.
That history doesnt seem to matter now as Democrats look to resist Trump at all costs, even if it means a government shutdown and a failure to pass a DACA fix.
The White House issued a series of unreasonable demands entirely outside the scope of our ongoing negotiations about DACA and border security, Schumer said last week.
Republicans, given Democrats voting history, are frustrated and confused.
Why do my colleagues in Democratic leadership refuse to even consider measures that would beef up border security and interior enforcement? Do they want people to continue to immigrate to this country illegally? Senate Judiciary Chairman Chuck Grassley (R-Iowa) asked Fox Newss Chad Pergrum this week.
Why wont Democratic leadership negotiate with us? Because we refuse to simply pass the Dream Act, as is, with no proportional border security and interior enforcement measures. As the Democrats see it, its take it or leave it. Their way or the highway, he continued.
While the American people support DACA, they also support strong border security and immigration policy in return for amnesty or protections similar to it. At this point, Democrats are more interested in using DACA as a political hammer against Republicans and the White House than they are concerned about solving the problem. After all, fixing the issue would take that tool out of their political arsenal for future debates.
If Democrats truly care about protecting DACA recipients, theyll vote for it in exchange for border security theyre already on the record supporting. Until then, theyre simply bluffing and using young people as pawns.

If we had an opposition party when Obama did this they could have sued and stopped this like the states stopped the Kenyanesian Usurper’s second illegal amnesty for illegal aliens, DAPA.

The GOP did not sue to stop DACA because they want amnesty, too.

It’s our way or the highway this time. We’ve already done the immigration thing their way several times before and we got totally lied to and cheated each time. No more.

I am really tired of the media and politicians telling us that the American people support amnesty for illegal aliens here in the US. We dont, I dont hear anybody out there other than on TV and in the media say that we should be giving amnesty to these illegal aliens. And if its just these 870,000 supposedly kids, that might be one thing, but nobodys talking about the 3 to 7,000,000 people that came with them who were not kids. How do we make sure that any amnesty for those so-called kids, does not include chain migration of the people who brought them here?

Aw, c’mon. They were just kidding back then when they voted for it. Red meat for the yokels. Haw haw.
No one is understanding that DACA is an illegal, unconstitutional act by Obama. It is NOT settled law. Yet, everyone is treating it like an amendment to the Constitution or the Federalist Papers or something. There is no precedence for it. So why does our side keeps accepting the false premise that we have to "do something" for people who were brought here illegally by their parents?
Also, illegal immigration on its face is human smuggling. It is human trafficking. No one talks about the rapes of women who have to do what the Coyotes want. No one talks about the children. No one is even talking about the environmental and health impact illegals are doing to this country. Over 90 people dead from the flu in San Diego County. Diseases that were dead in the 1800s are making a comeback.
We cannot take care of the world. Countries need to sink or swim. We cannot give out foreign aid to countries who still want to bring their people HERE. What are they using our foreign aid for? Isn't the purpose is to help them help themselves?
For me to be OK with any DACA, would take at least:
100% wall funded and built across the entire border
end immigration lottery
end chain migration
end anchor babies
deport all DACA who are on or ever received welfare, have a criminal record, over 18 and not high school graduate, cannot pass a rigorous English fluency test, cannot pass a true citizenship test, proof they have never voted. Any DACA left that are qualified must leave the country until the wall is complete, and then apply for re-entry and be vetted including based on merit.

Thats how a rational Republican would look at it. Apparently there are none in DC.
I would be happy without the wall if all the other were accomplished. Chain migration, no anchor babies and no voting would be fine with me with no wall. Plus deport all DACA activists and those with criminal records.

Problem was W really didn’t want it. W should have closed all borders and shut down the VISA system for 5 years on 9/12/2001. Very weak on his part.

Yup. And Trump did it so easily.
Notice, that is missing. IMHO that comes after Kennedy retires and we get his replacement. It is a 14th amendment issue, or more correctly the mis-interpretation of it. Ann Coulter wrote about it in the early 90's in NR...
