The Republican tax reform package agreed upon by House and Senate lawmakers contains language allowing illegal immigrants with American citizen children to get a tax credit.
The final GOP tax bill doubles the child tax credit from $1,000 to $2,000 and increases the amount of the refundable child tax credit to $1,400. This policy change geared towards helping working class families was pushed by Republican Sen. Marco Rubio.
The conference bill includes language from the Senate tax plan that allowed parents of so-called anchor babies to receive the tax credit.
In order to receive the child tax credit (i.e., both the refundable and non-refundable portion), a taxpayer must include a Social Security number for each qualifying child for whom the credit is claimed on the tax return, the bill states.
Jan Ting, a professor of law at Temple University, wrote an analysis recently about the Senate bills language.
Because of birthright citizenship, any children born to illegal aliens become automatic U.S. citizens. Thus, illegal aliens can still receive billions of dollars in tax credits for their U.S.-born children, Ting wrote in a post on the Center for Immigration Studies website.
Existing law allows taxpayers with a Taxpayer Identification Number to get a refundable tax credit, which many illegal immigrants reportedly have.
The original House Tax Cuts and Jobs Act included a reform that wouldnt have allowed illegal immigrants to get the child tax credit. It said refundable credits are only available if the taxpayer includes the taxpayers Social Security number on the return of tax for such taxable year.
The House bill requires a SSN in order to claim the child tax credit. Members will work to address this in conference to protect against fraud in this credit, a House Ways and Means spokesperson told Breitbart News over a week before the conference bill was agreed upon.
President Trump is supportive of the final GOP tax bill, and a White House spokeswoman did not return a press inquiry Saturday about the provision helping illegal immigrants.

If he can't or won't get on the phone and arm-twist to get the Senate Democrats and Repuke-icans in line to filibuster to delete Rubio's meddling on the "valid SSN" House version requirement for the submitter, BEFORE THE BILL IS VOTED ON, then you know he's going to cave and sign it as written. What the hell is wrong with him? Multiply $2,400 by 40 million. This little Christmas gift to our messican and braxxxilian amigos could cost the U.S. taxpayers as much as four billion six hundred million dollars. All the while they are going to be giving YOU the finger on the way to the bank.
This is an issue with birthright citizenship, not the child tax credit.

I'll give the GOP credit. At least they're now requiring a valid SSN to qualify for the CTC. Prior to this change, just a tax ID number was needed allowing "Dreamers" to qualify and resulting in billions of dollars of fraudulent payouts.

I called Rubio's office and thanked him for standing up for working Americans. I'm glad he was successful on this.
We need to encourage American nuclear families to have more children and American wives to be stay-at-home moms to raise them. This is the only arrangement that has ever worked.

This could be cured by requiring an SSN when giving birth in medical facility. No SSN, then country of origin is determined and reference to their consulate is made. The child does not receive a birth certificate, but is given sufficient information for their consulate to create one for their country of origin.
This is to conform with the laws of Mexico, who determines that children born of its citizens, regardless of location in the world, are Mexican citizens. We obviously don’t want to ‘trigger’ them. /s

The tax bill prepared by the House would NOT have prevented you and your family from obtaining the tax credit. It was prepared by Congress with U.S. citizens as the intended recipients. What Rubio did in the Senate version was to EXTEND the entitlement to ILLEGAL ALIEN parents who do NOT have valid SSN numbers to also take the credit based on the existence of “anchor baby” children who, through misreadings by the courts of Section 1 of Article 14 of the U.S. Constitution, have been and are granted automatic U.S. citizenship and valid SSN numbers. These numbers are ALL that the Senate version of the Bill requires for the tax credit application to be submitted and approved. This is WRONG on so many levels. No one on this thread is opposed to the tax credit being taken by valid U.S citizens.
The Uniparty will fight tooth and nail to keep the demographic changes they have made to the country through non-enforcement against the will of the citizens.

The misreading of Section 1 of Article 14 of the U.S. Constitution has nothing to do with Marco Rubio.
