First, our rights are not given by the Constitution or man or his government the way totalitarian states presume. Our rights come from our Creator God. So, we begin there - man born with God-given unalienable rights including Life and liberty.
Next, governments are formed to PROTECT those rights. The Constitution does not grant rights, it PROTECTS our PREEXISTING rights from the federal government. The Constitution creates and limits the FEDERAL GOVERNMENT, not the states which were also preexistent to the Constitution.
The reason for the first ten amendments were to assuage the anti-federalists in order to get the Constitution ratified by CONFIRMING EXPLICITLY certain rights the federal government had no power to violate. The first ten amendments are NOT a "Bill of Rights" - bills of rights are what you see in totalitarian state bylaws and constitutions. Totalitarian governments think government gives people their rights.
Remember, the First Amendment specifically and ONLY addresses CONGRESS, not the states.
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.First Amendment [I].
As borne out in the Ninth and Tenth Amendments which the Lying Left has done everything in their power to destroy, the constitutional presumption is 1) powers of the federal government are LIMITED to the expressed ENUMERATED powers DELEGATED by the states and the people via the Constitution and 2) those powers not enumerated to the feds are retained by and reserved to the states and the people.

Apart from a few specific expressed regulations in the Constitution, the states are sovereign and the states and the people of the states are free to do as they please. One of those regulations is every state MUST have a republican (representative) form of government (U.S. Const, art. IV, sec. 4). This ensures that the will of the people, including protecting their rights and freedoms, govern the state via their representatives.
The feds have NO blanket authority over the states OR the people. That is why we are a FREE country, governed not by the whims of tyranny of the Rule of Man, but by the Rule of Law, the Constitution of the U.S. And our task is to recover our Free Constitutional Republic from the tyranny of the feds.

There are natural rights that also are assured in the Constitution. Most of the bill of rights at this point has been taken to be incorporated down through the state level—including the 1st amendment.

Everything you posted is right on. Just because I used the term “Constitutional right” doesn’t mean I don’t understand everything you put out in your detailed post, and I’m sure all FReepers understand that. Just as the case with the baker suing for his first amendment rights to be protected so it is with the union case.
It was talked about back in January with Sessions. Looks like they found out things about that stupid law. Reminded me why I left a company that I was forced to sign with the Teamsters.

I wish that were true, but many FReepers don't actually get these important presumptions and issues of the Constitution. Why should they? Long ago schools stopped teaching the Constitution as written and originally understood and intended. Even law schools don't teach the Constitution at all, or if the do, what they call Constitutional Law has very little to do with the Constitution as written and originally understood and intended.
We're going to need God's help to restore our Free Constitutional Republic.

The cashier ladies liked me, and it ate him up.
haha I had the same situation at our local Safeway grocery store. The union rep was a Sopranos wanna be and he kinda knew us newbies wanted to kick his ass.

I wasn’t real thrilled about joining the union anyway.
I had them pegged early in life.
Trump’s racked up so much political capital with me,
he could shoot TWO guys on Fifth Avenue, and I wouldn’t care.
