A 23-year-old migrant, named Juusuf Muhamed Abbud, was acquitted from aggravated rape despite having intercourse with a ten-year-old girl. The court said it was not clear that the girl was “unable to defend herself and express her lack of consent”.
According to the Helsinki times:
“The Turku Court of Appeal ruled last week that the defendant was guilty of aggravated child sexual abuse but not of aggravated rape and sentenced him to only three years in prison”, thus upholding a ruling issued in March by the District Court of Pirkanmaa.
The defendant was acquitted of the charge of aggravated rape on grounds that the defense was unable to substantiate its claim that the victim had been unable to defend herself and express her lack of consent because she was in a state of fear and helplessness at the time of the act, according to Helsingin Sanomat.
Jussi Tapani, a professor of criminal law at the University of Turku, and Matti Tolvanen, a professor of criminal law at the University of Eastern Finland, said in an interview with the newspaper that the case could ultimately warrant the attention of the Supreme Court of Finland.
Both of them indicated that the criminal code fails to unambiguously define the grounds for determining that the victim was in a state of fear or other state of helplessness.
“The Supreme Court should set a precedent on whether or not a 10-year-old can be ruled to be able to express their will in circumstances such as these. I’m personally of the opinion that a 10-year-old would be unable to understand the matter and thereby defend themselves against an adult,” comments Tolvanen.”
Rape of a child 12 and under should be a capital crime.
Ok. No aggravated rape sentence.

In Sweden the police handed out "Don't Touch Me" bracelets to women in response to the refugee rape epidemic. perhaps that is needed in Finland. All ten year olds can wear "Please Don't Rape Me" so that when they are paralyzed in fear there is legal small print advising the perp of the child's intent.
Oh who am I kidding? They'd just say the refugee couldn't read it because it was in finnish and implied that refugees might want to rape girls, therefore illegal. The child would just get punished for lack of inclusiveness.
In the heirarchy of liberal identity politics, islam is at the top of the list. They can literally kill and rape whoever they want and the dems / socialists will pretend it's not happening and then toast them. After that in the USA is illegal immigrants, who have similar protections. Then gays, then blacks, and so on and so on until waaaay way down at the very bottom are women. They get lip service because the socialists / dems think they can be swayed by pure emotion but whenever they are being boxed out by another identity politics demographic, they lose. Trannies want your bathroom? They get it, prude. Illegals want to murder you? Acquitted, stop whining. Islam says you have no rights? Stop being so judgemental of their rich culture, bigot!

Understand that European laws have not caught up to the new realities. There wasn’t specific language in the legal code to address this, because it hadn’t been a problem.
This is not just an issue in Finland, or any one country... and changing legal code is not an overnight fix, often even here in the USA it happens after the fact, when a case highlights the need.

Definitely; the country of Finland itself was born from the ashes of WWI, and Russia was determined to get the choice parts back...
