....The FBI’s evidence against the former general could put him in prison for 60 years, but making a plea deal could reduce his sentence to six to twelve months, Judge Andrew Napolitano, Fox News senior judicial analyst, told FOX Business’ Stuart Varney.
Napolitano said Flynn may have shortened his sentence by offering federal prosecutors some kind of link to Trump or someone within the administration.
“Sometime between Monday and today, they reduced that deal to writing. [Flynn] has real evidence that we can really use to prosecute someone, perhaps the president, we don’t know, and in order to lock the general in they got him to plead guilty this morning,” Napolitano said on “Varney & Co.”

I’m surprised this guy Napolitanp ever had a legal career at all, based on the quality of some of the legal analysis he’s done on Fox over the years.

I am putting more faith and credibility in the analysis of Gregg Jarrett.
Flynn’s credibility as a witness is completely destroyed now that he’s been convicted specifically for lying. To be trusted again he would need verifiable audio or video evidence that may not even be admissible.

The Logan Act makes it criminal for any unauthorized citizen to negotiate with any foreign power against the interests of the USA.
When Flynn did so, Trump had been elected but not sworn in. That’s the kicker.
Then, Flynn lied to the FBI about those contacts, another crime.
Additionally, Flynn was not registered as a foreign agent, and that’s against the law also, to negotiate on behalf of a foreign power.
The FBI did wiretap a few calls between Flynn and the Russians but there was only very minimal incrimination.
But, Kislyak and other Russians were reporting back to Russia, contacts of a much more substantial nature that were clear violations of the Logan Act, that happened before Trump was sworn in.
So, the FBI figured out that Flynn was meeting with the Russians in person to avoid FBI eavesdropping, that’s what Flynn lied about. Instead of about 4 conversations with the Russians, there were about 30, mostly face to face, no records.
In fact, the Russians agreed to change their tactics at the UN because of an agreement with Flynn and his Trump contacts, before Trump was sworn in, that’s against the law, the Logan Act.
Additionally, Flynn was not registered as a foreign agent, and that’s against the law also, to negotiate on behalf of a foreign power.
Whomever, on the Trump transition team was Flynn’s handler is in big, big trouble. If Trump was told about any of these goings on before he was sworn in, he was obligated to tell the Justice Dept./FBI.
If not, that’s conspiracy and/or obstruction of justice. It may seem petty, because if they had waited just a couple of weeks, all these contacts would have been completely legal.
As with the Manafort indictment, I have a suspicion that Flynn's biggest crimes relate to his dealings long before December 2016.
I’ve said all along that innocence is no defense against a politicized prosecution. It’s naive to think it is. All the prosecutor needs are a couple canaries that will sing. rumor I have heard around the internet is that is Jared kushner the son in law... question is did Trump know and can they prove it...
Napolitano seems to get everything wrong. However, it’s possible that Flynn, a guy who was fired because he lied to the Vice President and pleading guilty for lying to the FBI, could make up anything about Trump. And, because this case could not constitutionally go to trial to cross-examine their star witness, the testimony of a proven liar would be the ‘rats case for articles of impeachment.
Kushner was the lead contact with the Russians and Israeli’s. I agree with you, Kushner has a big problem.
BTW, the FBI knew that Flynn was reporting back to Mar-A-Lago. They likely had a FISA tap and Kushner was the highest authority on the transition team and was living there.
