It depends: If in a public space (ie municipally owned cemetery) it is public; if in a mortuary or privately owned cemetery definitely private.
The grey area involves houses of worship (privately owned but considered "public buildings" for some zoning/taxation/codes purposes); irrespective the sidewalks and streets surrounding are definitely public.
The First Amendment can be very messy.
This could affect my plans for HRC’s service.

There needs to be a group that follows the WBC website and routinely alerts local activists to show up, surround and shield from view, the serious ass-kicking they receive.
I’m sure they wouldn’t be disturbed by local LEOs (standing back-to)
They need to be driving home bleeding, with splints, heads bandaged, and with no hint of who to sue.
So, perhaps maybe a hundred or so protestors continually outside Westboro ‘s maven like “occupy whatever” would be okay too. Free speech and assembly and all.... Maybe throw in a dozen Harley’s and a bunch of rock music and perhaps a handful of port-a-potties.....
Only problem would be finding folks who could take lots of time off from work etc- yeah, the rest of us actually produce value, rather than simply consuming others’ labor.

I’m fully aware of the PGR and it’s mission.
However, I’m advocating for somebody a little less kind. I’m pretty sure the PGR would never interfere to protect the WBC from a well-deserved ass-kicking, unless it was a rogue PGR member.
I figured the post funeral line to urinate on her grave would be too long.
When someone is having a private funeral, I would also include the funeral route and the land abutting the procession during the duration thereof. It is common decency.
I agree i like when a bazillion truckers or others show up to support the family and block westboro
Why don’t lefties sue the hell out of them for saying God hates homos?
