FORT BRAGG, N.C. Army Sgt. Bowe Bergdahl's brutal five years of captivity by Taliban allies carried significant weight in an Army judge's decision to spare him prison time for leaving his post in Afghanistan in 2009, legal experts said. Criticism of Bergdahl by President Donald Trump also appeared to push the judge toward leniency.
Army Col. Jeffery Nance didn't explain how he formulated the sentence that also included a dishonorable discharge, reduction in rank and a fine. But the judge had to consider a complex array of arguments for and against leniency.
Prosecutors asked for a 14-year prison sentence, citing several service members' serious wounds while searching for Bergdahl. The defense sought to mitigate the punishment with evidence of Bergdahl's captivity, mental illnesses, contrition and Trump's harsh criticism.

The judge was appointed for this case during the Obama Administration. I do believe that has a pre-determining factor here. The Obama Administration has a long history of putting its thumbs on the scales of justice!
He's got a wedding ring, but he must be married to a man. The picture in post #7 is creepy.
Anyone know if his sentence can be appealed, as too lenient? You know, by the good guys upstairs in the chain?
It’s like situational ethics: “trust us on this because you’re too dumb to understand.”
I didn’t know military judges could change a sentence that was written into military law. Everyone, I mean, everyone knows the punishment for desertion!
Should have been hanged.

No setencing minimums/guidlines in the military?
Let’s not forget that senator McShame got off too - that communist collaborating, plane wrecking, reckless murdering SOB.
The cartoon is from Pakistan. It seems as their judiciary is corrupt . Corrupt judges, a common maladay the world over.
The judge and the AP chose to ignore the “brutal” deaths of 6 soldiers or the “brutal” injuries of the Master Sergeant who can not walk, talk or take care of himself after being shot in the head looking for the “honorable” “Sergeant” Bergdahl. None of that matters a wit when you cover for and love treason. Yeah, the Judge had to consider a lot. Master Sergeant Allen has to consider a lot too when he wants to hug his daughter or even get out of bed.
So he was a defense counsel? I guess protecting criminals never left him.
General Officer promotions have to be approved by Congress. His name would never stay on the list now.
I don’t understand where the deterrence factor comes in if I can leave my post, wander off into the night, and leave my comrades exposed with fear of punishment.
The judge should be run over by a collum of tanks.
Hubby too. He was a Green Beret in Vietnam and all this Beret crap just pizzes him off. Lol
Apples and oranges. The case brought to the judge’s court was his desertion, not his vacay with the Taliban.
He is probably perfectly willing to sacrifice his honor and promotions for Obama and the cause.
There was nothing “complex” about the Begdahl case. Bergdahl admitted to desertion. The penalty for desertion during time of war is death or such other punishment (such as life in prison) as a court-martial may direct. Not only was Bergdahl a deserter, it’s probable, since the enemy didn’t kill him, that, worst still, he was also a turncoat.
