Nope, only with an eye towards reducing the sentence. The sentence cannot be increased by anyone or anything. Further appeals, review and action by the Convening Authority, or requests for clemency to the Convening Authority can only act to reduce the punishment adjudged.

I didn’t know military judges could change a sentence that was written into military law. Everyone, I mean, everyone knows the punishment for desertion!

There are no automatic punishments in a military court. The sentence for any crime in the military ranges from "No punishment" up to the maximum permissible punishment established in the Manual for Courts-Martial.

Isn’t the sentence a contradiction?

If his ‘imprisonment’ was not his fault and considered time spent as a prisoner harsh enough. why go through the sham of a RIR to PVT and a DD?

Wasn’t/Isn’t the policy for POWs to be given their advancements as they come up with the assumption being they would have either been promoted or passed if an exam required?

So, with the Judges ruling the rest of the sentence should have been a promotion to cover the couple of years he spent ‘locked up’ while awaiting GCM and maybe a General Under Honorable Conditions Discharge-IF they took into consideration his conduct may have been undesirable.

I seem to remember the phrase ‘Six & a kick’ which I am assuming to have meant 6 years in Leavenworth and a DD and I believe the Leavenworth trip brought a Rate Change to E1 for record keeping purposes and upon release from your cell one was unceremoniusly escorted out the front gate.

NOW back in the day day, the escort out the gate meant standing there with your rate stripped and being escorted by horsemen and ‘marched through the ranks of your fellow EX soldiers’ and all vestiges of your past Army service to be removed from your person or property and therefore BRANDED for life.
Not sure if yellow stripe painted on back or not (cowardice) but I am sure the Troopers had their way with their ex-comrade once the Brass was ‘out of sight’

re Chuck Connors, ‘Branded’ c 1965-66 who spent the ‘rest of the series’ fighting the Cowardice charge while bringing justice to the frontier....etc etc etc

NOT to be confused with Nick Adams as Johnny Yuma who also spent time wandering the Wild West in the pursuit of Justice for the common man while searching his soul for himself....

(or something like that)
