Sgt. Bergdahl’s Sentence May Be Lighter Because of Trump’s Comments

FORT BRAGG, N.C. — President Trump’s harsh criticism of Sgt. Bowe Bergdahl, who walked off his Army post in Afghanistan in 2009 and was captured by the Taliban, will weigh in favor of a lighter sentence for the sergeant, a military judge said on Monday.

“I will consider the president’s comments as mitigation evidence as I arrive at an appropriate sentence,” the judge, Col. Jeffery R. Nance of the Army, said during a hearing at Fort Bragg. The judge is expected to sentence Sergeant Bergdahl in the next few weeks.

The judge rejected a request that he dismiss the case or cap the length of the sentence on the ground that the president’s comments had precluded a fair hearing. The judge said he had not been influenced by the remarks and that the public’s confidence in the military justice system had not been undermined.

Sergeant Bergdahl faces up to life imprisonment. He pleaded guilty to desertion and endangering troops sent to search for him.

Don't like the sound of this from the judge, he's setting it up for possible time served as POW in my view, at least he didn't dismiss case though.

A back door attack on the president.

If the judge thinks the president’s comments influenced himself or the anyone on the Court Martial board he should have recused himself or replaced anyone who admitted they could not be impartial.

If this is true, then there's no reason to consider Pres. Trump's comments made when he was a candidate.

I'm sure he's taking into account Susan Rices's comments.(s/off)

Just follow the federal sentencing guidelines for manslaughter. Manslaughter is appropriate as his desertion resulted the death of 8 soldiers. Ten years per person who died after his desertion who was ordered to go look for him.

8 x 10 (minimum sentence) = 80 years. Heck, make it even more “appeals proof” by giving him credit for time served in US custody.

President Obama and his aides tried to cover Army Sgt. Bowe Bergdahl in glory, even receiving his parents at the White House. But contradictions in his story of captivity in Afghanistan have overturned the narrative.

Sgt. Bergdahl now faces a general court martial and similarly, Mr. Obama’s exchange of terrorists imprisoned at Guantanamo Bay for his return is weighed in the court of public opinion.

Attempting to trade America’s security for a public relations coup disgraces the nation, and most of all, the president himself.

The Army charged Sgt. Bergdahl with desertion and misbehavior before the enemy, a serious indictment for which he could be sentenced to life in prison.

The 29-year-old soldier disappeared from his unit in Afghanistan in 2009.

He was captured by the Taliban and had been held in captivity for five years when the president traded him for five senior Taliban commanders imprisoned at Guantanamo Bay. No date has been set for the court martial.

The Pentagon’s sober announcement is a jarring departure from Mr. Obama’s stagecraft in May 2014 when he appeared with the soldier’s parents in the White House Rose Garden to celebrate the news that Sgt. Bergdahl had been freed.

The president’s national security apologist, Susan Rice, said he had served “the United States with honor and distinction.”

Then his fellow soldiers came forward to tell another story, that his disappearance had all the signs of desertion, and that a half-dozen American soldiers were killed searching for him. Some honor. Some distinction.

The Bergdahl case has become a symbol of Mr. Obama’s determination to redeem his 2008 campaign pledge to close the prison at Guantanamo Bay, national security be damned.

The five Taliban evildoers are only the most notorious of the hundreds of foreign fighters the president has released over the years.

Mr. Obama rationalizes that the prison is a recruiting tool for terrorists. More accurately, America’s very existence is a recruiting tool for terrorists, and the president’s job is to defend the nation.

This is the only sentence in quotes in the article. The judge did not say what the author wrote ie ....will weigh in favor of a lighter sentence for the sergeant. Me thinks the author is trying to put words in the colonel’s mouth.

The opposite actually. Sentencing the traitor to time served won’t hurt him a bit in Twinkle Toes Mattis’s DOD. OTOH, a stiff sentence is a sure career ender during the next Democrat admin.

If he pleaded guilty how did anything Trump said influence the court? The only person "influenced" is the judge (who is supposed to be above being influenced) who is taking advantage of Trump's comments to let this admitted traitor walk.
