IRS to block, suspend tax returns that lack Obamacare disclosures

The IRS says it will not accept electronic tax returns that do not disclose whether the filer had health insurance coverage during the year.

It also says it will suspend paper returns that do not have the disclosure.

The IRS' move, which will bolster compliance with Affordable Care Act rules, comes as the Trump administration takes other steps to undercut the law.

The IRS is warning tax professionals that it will block or suspend processing of 2017 income tax returns that do not comply with Obamacare rules requiring filers to disclose their health insurance status.

The new move to tighten Americans' compliance with the Affordable Care Act comes even as the Trump administration takes steps to undercut it.

"Taxpayers remain obligated to follow the law and pay what they may owe at the point of filing," the IRS said in a description of the new policy.

The ACA requires most people to have some form of health insurance coverage or pay a tax penalty — a requirement known as Obamacare's individual mandate.

That penalty is the higher of 2.5 percent of adjusted gross household income or $695 per adult and $347.50 per child under age 18.

The agency, in an online notification to tax professionals, said that in the upcoming tax filing season "the IRS will not accept electronically filed tax returns where the taxpayer does not address the health coverage requirements of the Affordable Care Act."

"Returns filed on paper that do not address the health coverage requirements may be suspended pending the receipt of additional information and any refunds may be delayed," the IRS said.

Income tax returns contain a box that asks filers if they had health coverage during the year.

If they indicate they did not have coverage, filers must indicate on what grounds they are exempt from the mandate or say they will pay and then calculate the penalty for not complying.

The IRS said it will not accept electronically filed returns until a tax return addresses those points.

There are several possible exemptions from the mandate, including lacking access to affordable health coverage, being homeless, getting evicted, experiencing domestic violence, experiencing the death of a family member and filing for bankruptcy.

I thought Trump ordered the IRS to accept all returns. Even without the disclosures. Who has gone rogue? the IRS OR DJT?

The IRS reports eventually to POTUS. Time for Trump to take this in hand.

I could have sworn one of President Trump’s first executive orders directed the IRS to accept tax returns without the insurance information provided. Was I mistaken or is the IRS just ignoring a Presidential order?

No delegated power to levy a tax on not complying with a regulation. THAT is and should be called a fine ... and fines merit receiving due process (as well as protections against self incrimination)!

Never mind that there is no delegated power for the underlying regulation in the first place!

If I had had the Mask for a day you can bet that it would be Obama, Roberts, and the a Democrats in Congress who would have the car bumpers shoved up their sorry asses and not some mechanics.

Is President Trump going to stand for this? The do-nothing Congress should IMMEDIATELY pass the tax reform bill making it retroactive to 2016, declaring Obamacare penalties null and void.
Barring this action on the part of the patsies in Congress, Obama changed the Obamacare rules several times by executive order, so President Trump should do the same.

Unemployment of current leading IRS staff seems in order.

They have and use fully automatic weapons. That likely confirms their role as enforcers of some sort.

Do you know how frightened folks are out here? of our government?

Once hidden, the absolute power the left has is outted for us to see and fear. If Trump can’t stop them, there is no one else.. but God. They have “transforming our country” in mind.. and plans.

I’ve lived a long time.. but the younger folks have a lifetime yet and the evil of the left is just plain scary. Things used to be slower in change.. today it’s something more every day to take our foundations out from under us. Fast track to destruction if the left have their way.

Lamppost. Rope.

Time to start putting some fear into the ruler’s enforcers.

In some cases, the state takes care of you - like for acute care following major surgery in a nursing home.

Few people can afford it and we’re the only country in the world forcing older people to impoverish themselves before their catastrophic health care costs are covered.

Obamacare didn’t fix it even though we have a rapidly aging population and Americans are only getting older.

The IRS check box doesn’t address the issue. This is what private health insurance seldom covers. I thank God for Medicaid.

The IRS is full of liberals. Trump needs to fire the first three level of management.

The IRS won’t ask about immigration status or proceeds from illegal activity but they will ask about social engineering.

Who says they’re political?!?!

Yes, but if this is part of the plan to win by enforcing Obamacare to the letter and using the people’s outrage (leveraging the 2018 midterms) to finally get rid of this monstrosity, I support it.

Also, perhaps this is a backdoor method to try and stop the illegals/scammers from getting ill-gotten refunds? Maybe a common “error” in those filings is the proof of insurance portion? Previously, the IRS/Obama would let them pass but under Trump, that leakage of $$$ will stop...or at least slow?
