Moore could have gone with a tried-and-true call to arrest all flag-burners, as there’s a large audience receptive to that argument within the GOP, but it wouldn’t have been topical. You must a be a victim of the government run school system, because otherwise you should have learned that Bill of Rights, generally, and the the "speech clause" in the 1st Amendment, specifically, only apply to the government, not private employers.
There’s a lot of “Should” in that statute.
In other words, it’s not compulsory, because making this compulsory would violate the First Amendment.
