Gregg Jarrett: Trump is correct, NFL teams can legally fire players for their conduct

The First Amendment does not protect National Football League players from being fired.

The Constitution’s freedom of expression applies only to government action, not private businesses.

The First Amendment states, “Congress shall make no law…abridging the freedom of speech.” It says nothing about private action or reaction. Thus, it is a public misconception that free speech or expression extends to the workplace. It does not, as the U.S. Supreme Court has consistently ruled.

Any business, as long as it is not connected to the government, is entitled to fire an employee for his or her speech and conduct within the workplace. The NFL and its teams are privately owned. They are not constrained by the principles of the First Amendment.

But even if statistics do not reliably show that offended fans are damaging a team’s finances, it is not necessary. If an NFL owner considers the players’ conduct to be disrespectful such that it reflects negatively on the club, this is enough for termination under the two contracts cited above. And, again, the First Amendment does not provide protection.

There are some who alleged that firing players would constitute racial discrimination. This misunderstands the law. It is true that racial discrimination in the workplace is forbidden everywhere in America under the Civil Rights Act of 1964. But firing a player for his conduct is different than firing him for the color of his skin.

Didn’t I read that Colon got a big fine for not wearing approved headphones? If they can enforce that they can enforce respect for the country that gives them the freedom to protest on their own time.

I don’t think that any rational person thinks that the NFL owners couldn’t cut any player who protested, or for any other reason. The lunacy would be thinking that they would.

The media is just being dishonest, they know this. They repeated it a hundred times when a conservative is fired for something they said or did when it isn’t PC.

It’s just selective support and outrage. They’re in a pure hateful, bigoted, mob place - yet don’t know it.

Try doing this Freedom of Speech thing in the Private Sector and you will be out on your behind the next day.
The guy in Silicon Valley simply wrote a letter describing the conditions inside the company....gone.

If Jerry Jones cannot get Goodell fired and/or change the current anti-American direction of the league, look to a rump organization of teams that make a break from the NFL.

There's no reason to go down with a ship of 31 other fools. These are $billion dollar organizations that are entirely dependent on *optics*. Dallas, along with 7-9 other high profile, large metro teams (eg Chicago, DC) could easily create a new league which would be able to instantly sign new media contracts.

The league is in league with the players who are pawns in the social war underway.
They could have stopped this cold last year but chose poorly.
Now they will lose billions.

For more years than I can count -- and most recently, today -- I have tried to explain to "constitutional scholars":

"Free speech means only that GOVERNMENT cannot squash your speech. Not only does your employer have the right to decide what you can and can't do while you're working, but YOU agree to these restrictions the moment you agree to start working there."

Invariably, I am met with "But free speech!" No matter how many times I try to teach Constitution 101, I always end up banging my head against a brick wall.

Exactly. All day long I’ve been hearing that the President doesn’t understand free speech and I’ve been pointing out that it doesn’t apply to private business. I doubt this will stop the claims though.
