Gregg Jarrett: Trump is correct, NFL teams can legally fire players for their conduct
Fox News ^ | September 25, 2017 | Gregg Jarrett

Posted on 09/25/2017 12:25:45 PM PDT by Jane Long

The First Amendment does not protect National Football League players from being fired.

The Constitution’s freedom of expression applies only to government action, not private businesses.

The First Amendment states, “Congress shall make no law…abridging the freedom of speech.” It says nothing about private action or reaction. Thus, it is a public misconception that free speech or expression extends to the workplace. It does not, as the U.S. Supreme Court has consistently ruled.

Any business, as long as it is not connected to the government, is entitled to fire an employee for his or her speech and conduct within the workplace. The NFL and its teams are privately owned. They are not constrained by the principles of the First Amendment.

>>Snip<<

But even if statistics do not reliably show that offended fans are damaging a team’s finances, it is not necessary. If an NFL owner considers the players’ conduct to be disrespectful such that it reflects negatively on the club, this is enough for termination under the two contracts cited above. And, again, the First Amendment does not provide protection.

There are some who alleged that firing players would constitute racial discrimination. This misunderstands the law. It is true that racial discrimination in the workplace is forbidden everywhere in America under the Civil Rights Act of 1964. But firing a player for his conduct is different than firing him for the color of his skin.

The First Amendment clearly doesn’t extend to NFL players on a football field. The NFL has a whole list of rules and regulations about what players can and cannot wear on the field, just to cite one simple example.

How stupid have we Americans become regarding our Constitution and our government. Something just posted earlier today said only a small % of Americans asked could name the three branches of our government. The Lying Leftist agenda of deliberately dumbimg down American citizens is almost complete.

The first ten amendments are directed straight at the federal government and nowhere else. It is the FEDERAL GOVERNMENT (”Congress”) who cannot make a law abiding our rights and freedoms. The feds ONLY authority is that which is delegated and enumerated in the Constitution. ALL OTHER POWER remains with the states and the people (U.S.Const. Amend IX and X).

OF COURSE the NFL has the right to hire or fire whoever it wants and whenever it wants. That’s what freedom and free enterprise is all about.

We are a FREE CONSTITUTIONAL REPUBLIC, NOT a communist country!!!!!!

It’s not the Constitution keeping them from being fired, it’s the CBA. This is not proscribed behavior. At least not in the NFL. Interestingly enough the NBA outlawed this behavior over a decade ago.

“The Constitution’s freedom of expression applies only to government action, not private businesses.”

The fact that this even needs to be said is sad.

Do you intend to post your comment in every NFL thread on FR?

We get it. We’ve all read it a dozen times now.

Sheesh.

“The 1st Amendment “allows” the players to say or do whatever they want.”

The 1st amend doesn’t ‘allow’ it, their own idiot mouths and behavior allow it.

You folks are missing something. Can the owner keep the ‘guaranteed bonus money’ that has not been paid?

“There is an only very limited window of opportunity for the various NFL franchises to act, before the tarnish grows so great it cannot ever be redeemed.”

Yup, imo it’s too late. It’s hard to put that ‘unified’ anti-American display back in the bottle. Needle and the damage done.

It was ritual career & corporate suicides ala jim jones.

Obama’s legacy

That whole year leading up to the election I had a feeling that Super Bowl XXV might be the last.

I thought if Hillary might won the election she would cancel football by Executive Order.

I never thought that the league itself would work purposely for its demise.

I agree. The fact that we’re even having to educate folks, who’ve been dumbed down by public schools, universities, media, etc is just as heartbreaking.

You make a great point. Strange that an organization would purposely try to destroy its own self.
