What if the President wanted to rescind his own executive order? Is that legal?
Do any of those states have a republican governor? Talk about outing RINO’s.
It is generally legally binding if it is focused on legitimate things E.O.s are supposed to address. Even then, the next president can nullify, or change them with a new E.O.
A president can’t unilaterally issue an edict like DACA. That is the business of the U.S. Congress. Congress Legislates.
Neither the Executive Branch of the SCOTUS is authorized to legislate.
Trump saw things differently concerning DACA, and began a process to end it or force Congress to pass legislation making it a legal program.
I personally hope they don’t.
For a Federal judge, no legal leg is necessary.
No Standing....
15 states huh?
The Democrats currently have governorships in only a measly 16 states(their lowest ever). At this rate, they are going to go even lower.
“In 2015, the U.S. Fifth Circuit Court of Appeals blocked Obamas executive orders because the policy forced states to support illegals with state funds and because Obamas actions summarily changed the status of millions of illegals without Constitutional justification.
Obama lawlessly surged ahead and put his plans in place, anyway, quite despite what the 5th Circuit and a lower court ruled.”
DACA is a “political question” now.
Their salient reason for doing this would be to jam a dilatory stick into the operation of government and the administration of justice.
The lawyers joining in this lawsuit would be disciplined in a sane, free, law abiding state for counseling and maintaining an unjust legal action and for commencing an action from motives of political passion.
One of the participants, the great state of Oregon, is home of magistrate Monica Herranz who smuggled an illegal charged with DUI out of her chambers and aided and abetted his escape from ICE, thereby breaking federal and state laws and presumably one or two sworn oaths as well.
The Democrats and their open borders pals walked right into the trap set by AG Sessions.
He is allowed to change his mind.
If we knew the truth of it, I’ll bet they morph their own E.O.s more often than we are aware of, adding in additional points or parameters.
The states sued to stop DAPA Deferred Action for Parents of Americans (DACA recipients and anchor babies). A much larger number of illegal aliens.
Their case stopped DAPA. It has no legal basis.
No one sued to stop DACA because the GOP wanted any amnesty they could get.
The states were going to sue to stop DACA if Trump did not.
That’s why he moved now. He did not want to defend this in court and lose.
Obama had no authority to give out SS#s and work permits to illegal aliens.
Massachusetts has a so-called Republican governor. Charlie Tall Deval Baker
It was a tie vote, so it went back to lower court, which ruled it illegal to begin with.
1. The carefully selected far left wing Democrat district judge will find for the plaintiffs.
2. The carefully selected D.C. Court of Appeals will affirm.
3. Next year, the Supreme Court will reverse in a 5/4 decision.
I can’t see how, legally. Its not a law. The DACA executive order clearly states that authorities will not enforce the law.
Yes, but that was before Gorsuch. With Gorsuch, they will lose.
So called is right.
What way will Roberts vote this time?
