U.S. Virgin Islands seizing guns, ammo in anticipation of Irma

The governor of the U.S. Virgin Islands has ordered the territory's national guard to begin seizing guns and ammunition from citizens in preparation for Hurricane Irma's landfall.

In an executive order signed Monday, Gov. Kenneth Mapp instructed Adjutant General Deborah Howell "to take whatever actions she considers necessary to carry out the assigned mission" of maintaining and restoring public order.

"The Adjutant General is authorized and directed to seize arms, ammunition, explosives, incendiary material and any other property that may be required by the military forces for the performance of this emergency mission," the governor said in the order.

The order went into effect Tuesday at 12:01 a.m.

US Law prohibits confiscation of otherwise lawfully possessed arms.... page 69-70 of this act....

Sec. 706. Firearms Policies (42 U.S.C. 5207)*
(a) Prohibition on Confiscation of Firearms - No officer or employee of the United States (including any member of the uniformed services), or person operating pursuant to or under color of Federal law, or receiving Federal funds, or under control of any Federal official, or providing services to such an officer,

(1) temporarily or permanently seize, or authorize seizure of, any firearm the possession of which is not prohibited under Federal, State, or local law, other than for forfeiture in compliance with Federal law or as evidence in a criminal investigation;
(2) require registration of any firearm for which registration is not required by Federal, State, or local law;
(3) prohibit possession of any firearm, or promulgate any rule, regulation, or order prohibiting possession of any firearm, in any place or by any person where such possession is not otherwise prohibited by Federal, State, or local law; or
(4) prohibit the carrying of firearms under Federal, State, or local law, solely because such person is operating under the direction, control, or supervision of a Federal agency in support of relief from the major disaster or emergency.
(b) Limitation - Nothing in this section shall be construed to prohibit any person in subsection (a) from requiring the temporary surrender of a firearm as a condition for entry into any mode of transportation used for rescue or evacuation during a major disaster or emergency, provided that such temporarily surrendered firearm is returned at the completion of such rescue or evacuation.

(c) Private Rights of Action -

(1) In General - Any individual aggrieved by a violation of this section may seek relief in an action at law, suit in equity, or other proper proceeding for redress against any person who subjects such individual, or causes such individual to be subjected, to the deprivation of any of the rights, privileges, or immunities secured by this section.
(2) Remedies - In addition to any existing remedy in law or equity, under any law, an individual aggrieved by the seizure or confiscation of a firearm in violation of this section may bring an action for return of such firearm in the United States district court in the district in which that individual resides or in which such firearm may be found.
(3) Attorney Fees - In any action or proceeding to enforce this section, the court shall award the prevailing party, other than the United States, a reasonable attorney’s fee as part of the costs.

I guess that was my second question...how many of those guardsman would fire on a US citizen for exercising their constitutional right to keep and bear arms?

THIS is why right thinking people are opposed to gun registration laws.

The firearms of all blacks and whites that lived in NOLA during Katrina were taken away by the ATF guys. Why???

These folks wanted to keep their weapons to shoot any looters on sight.

President Bush really burned a lot of folks in NOLA during Katrina.

Of course, our darling MSM never said a thing about this little matter of guns for protection that were taken away by the ATF folks.

That’s why under this specific set of circumstances you create the appearance of compliance. Fighting it out on a small island against guardsmen is only going to end one way

Lotta ifs, ands, and buts there. You either have a constitutionally protected inalienable right, or you don't.

If you're not willing to fight for your rights (as our forebears did), then those 'rights' are mere privileges, subject to revocation at any time.

If you're the only man in town who's willing to tell the jack booted thugs where to stick their confiscation order, then yeah, you may wind up paying the ultimate price for doing the right and honorable thing.

On the other hand, if you band together with like-minded neighbors, and let the government know in advance that they'll have to pry them from your cold dead fingers, things will likely go the other way.

LOL, it may “apply” in theory but not in practice. I lived there in 2012 and 2013 and I can tell you flatly that you will be arrested most particularly if your white and you will be put in jail and god only knows when you would get out. The only law down there is what black politicians and legislators and the Governor say is law. The US Constitution is laughable.

Only black folks have guns down there (and not the good ones) and the cops, in most cases, are scared of them. I must say in their defense though that several of them took on several of the bad guys head on at a restaurant back in 2012. Both sides had automatic weapons blazing and the Chief of Police, a white guy was badly hurt. I think one or both perps were killed. Two weeks earlier my daughter and I were serenely eating lunch there.

I left VI because you have no way to defend yourself and IF you a buy a gun and register it with the cops they sell the info to bad guys on the street who come to your condo in the middle of the night (you gave your address on the permit) or whenever they please and hopefully they don’t kill you. Some friends of mine were hacked to death on St. Maarten where I moved to after leaving VI. After the friends died I left. Simple as that.

The island of St Croix has been a mess since the big oil refinery shut down. IIRC the gun registry was used as a means for criminals to acquire guns. They were somehow able to access the information...
