Judge Richard Posner of the Seventh U.S. Circuit Court of Appeals announced his retirement Friday afternoon, affording President Donald Trump the opportunity to replace a legal titan on the Chicago-based federal appeals court.

Posner subscribes to a method of judging called “pragmatism,” which seeks to balance the equities of each case and conform judicial rulings to the social, political, and economic arrangements of the times. He touted his commitment to pragmatism in announcing his retirement.

They are all conservative constitutionalists.

Yep. While the RATs are screaming Russia collusion, he is quietly appointing great judges. I just wish he would fire SHOOT the leakers and Obama/Clinton holdovers. Life would be much easier for him.

I don’t see how filling one single appellate seat is that big a deal. Yes, Posner was a unique jurist because of his prolific writings. He had drifted leftward on same sex marriage, abortion, and economic regulation (post financial crisis). The Democrats will stall the hell out of whoever Trump names.

No, they haven’t. Quite the contrary, they have “blue slipped” all his circuit court judges. He set a RECORD with 15 either confirmed or blue-slipped already (meaning confirmation guaranteed) and he has one more with one blue slip in, so he could end up with 16 (JFK only had 14).

Throw in the Posner replacement and Gorsuch? It’s a sea change.

Circuit judges are a vital battle ground- one of the first things the Clintons went after. That and learning Bible speak. Seriously.

Cruz perfected that Bible speak business. No record of him darkening the the doors of a church with attendance.

These things get votes whether authentic or not.

Smart, influential, scholarly, practiced, . . .
lots of words but on the whole, we could (and will) do MUCH worse that this fine man.

Trying to get the whole picture of a guy like Posner is a very difficult thing. Books will be written, dissertations defended, arguments made, but will all fall short.

Posner is the one who said that studying the Constitution is a total waste of time, that it is irrelevant to the modern era.

The Constitution did not set up the Judiciary as the last and sole arbiter of Constitutionality. That was an assumed power that the Executive and Legislative branches acquiesced in.

I also recall some of my Liberal friends hating Posner. Now I’m confused.

He is one of the most respected jurists in US history for very good reason - and not the reason you think. He was on the libertarian - economic freedom end of the spectrum and certainly a central member of the Chicago school of law and economics, which also probably doesn’t mean anything to you - but it should.

And an oath-breaker.

That means A LOT to me...

Trashing voter ID, and his claim of “inevitability” in making patent law are just two of this jurists bad decisions.

Yes. and an oath breaker.

Correct. My point still stands: ultimately the error lies w/ the electorate in electing those that allow said acquiescence, time and time again.
