Salt Lake City Mayor Jackie Biskupski announced that as a result of the criminal investigation being launched by the Salt Lake County District Attorney, Detective Jeff Payne will be placed on full administrative leave with pay.
Later Friday night, police stated two employees are on administrative leave. It was not immediately clear who the second employee is.

You are correct, the nurse followed hospital policy, and the law. She was in the right and if she pursues it she will get a nice chunk of money.
Another issue, most of the law concerning getting a blood test without consent, without warrant pertains to people that are under arrest. I think the reason hospital policy is what it is has to do with liability and HIPAA, along with other laws and case decisions since HIPAA became law. I don’t think many posters realize how the passage of HIPAA actually seriously restricted LE actions on patients. Before HIPAA LE could basically go to a hospital and do as they pleased. HIPAA makes medical professionals and their employer responsible for patient rights. Legally hospitals can no longer allow things that are contrary to law- and if they do they are responsible.
The hospital policy only allowed blood draws for or by LE if circumstances were one of three:
Patient consent; if that is the case the hospital/personnel are off the hook- the patient themselves made the decision.
Patient is under arrest; if that is the case the agency that arrested him is responsible for legalities of things they request or do to the patient. Again hospital/personnel off the hook for LE decisions.
Law Enforcement has warrant; in this case a judge has signed off on the request, putting responsibility on judge/LE Agency. Again the hospital is not responsible for actions done or ordered by LEO if there is a warrant. I do have to note I am aware of a case where there was a warrant but LE asked doctor to do more than warrant called for, and he complied with request- lawsuit lost by doctor and hospital on that one.
In all those circumstances the hospital and their personnel are off the hook for legalities of decisions made that LEO wants done or to do themselves to a patient.
If the hospital gets into exigent circumstances, probable cause and other details of law, then they are in the position of determining law and intent of that law. If they are wrong they are responsible for actions they do or allow to be done to patients by LEO under HIPAA and other laws governing patient care and rights.
He died. I did not know.
How much medical attention did he NOT receive at a critical moment because his nurse was being harassed by this detective?!
Perhaps this is a small part of why he didn’t make it.

The mayor needs to grow a pair and order the detective arrested for assault (against the nurse) and interfering with a medical emergency at the least.
1. It was still a fishing expedition and nothing more.
2. I think the cop is in even more trouble now. There is certainly a claim that his interference in the victim's treatment contributed to the death of the victim. This is a criminal issue.
I just did some additional research and came up with this:”An Idaho police department is thanking a Utah nurse for stopping a Salt Lake City officer from obtaining a blood sample from one of their reserve officers who was unconscious in a hospital.
Police in the eastern Idaho town of Rigby said Friday that William Gray was severely injured in a Utah crash in July when the semi-truck he was driving for work was hit by another car.
Rigby police said in a statement they didn’t know until Thursday that the nurse was arrested after refusing to allow blood to be drawn from Gray.
The department thanked the nurse, Alex Wubbels, and hospital “for standing firm” and protecting the Gray’s rights.
It says he is still hospitalized.”
So what I read earlier and reported is evidently not true. Wm. Gray, the injured truck driver is alive and still hospitalized!
The incident happened well over a month ago.
Getting the video out lit a fire under someone’s ass.
The roided up loud mouth who lectured her in the car afterwards and wouldn’t talk with administrators should also be fired.
Then sent to prison.
What else has he been involved in?
Can you imagine how this would have turned out had there been no video of the incident? Cop: the nurse took an aggressive stance, then she lunged at me. I backed away. Then I think she tried to grab my gun. That’s when I had to restrain her.
And we would have most of FR's cop groupies here telling us how SHE should be executed.

What is amazing to me is that if the trucker was in ICU, he has already had blood draws and tox has already been run so that the treating docs know what they are dealing with.

I think she has the duty to safeguard an incapacitated person, which is what she was actually doing.

The truck driver was unconscious. He has the right to deny a blood test.
