A U.S. appeals court refused Friday to clarify the scope of the Supreme Court's lifting of the blockade against President Trump's travel ban, citing a lack of jurisdiction.
Earlier Friday, the state of Hawaii had asked the U.S. 9th Circuit Court of Appeals to expand the categories of people who can bypass the travel ban.
On Thursday, a U.S. district judge had refused to act on Hawaii's request, leaving in place the Trump administration's rules regarding what classes of people to exempt from the travel ban.
The judge in that case, Derrick Watson, also claimed he did not have the authority to act on Hawaii's request.
Watson, who originally ruled to block the travel ban, said in his decision that Hawaii should bring its challenge of the Trump administration's definition of "bona fide relationship" to the Supreme Court.

Shows that the Left thinks such entities as the 9th Circus are their own candy stores for when they don’t like something.
Home at last. Someone is home.
I am for busting up the 9th Circuit Court. It’s a Ship of Fools that continues to push a far left made up way of decision making. And they have a left wing agenda which is the reason that they get overturned as much as the do by the SC.
Some of the rationales I’ve seen for lifting the travel ban from mostly terrorist countries have been ludicrous.
If we are to believe some of the arguments against the travel ban, those terrorist countries are the source of most tourism, and without those tourists, the entire tourist industry would collapse. I’ve also seen the claim that the travel bans are racist—which is specious, considering that most of the Muslim countries in the Middle East and north Africa are populated by Caucasians, most of whom are white (some Caucasians are very dark). The bans were not even anti-Muslim religion, since most Muslim countries were not included in the bans. If the original judges who struck down the travel bans had actually been basing their decisions on law and the facts, they would not have struck down the bans. They based their decisions on politics, nothing more.
Best thing about Hawaii is getting lei’d as soon as you step off the plane.
It’s gonna really suck for that Dem judge shortly
and the bamsters friend when he is replaced .
That’s another story wide in range about
the bamster “s time in Hawaii.
Take down that judge’s name and do your research.
9th getting tired of being overturned by the Supremes.
Tired of looking like the hacks they are.
Worthless bunch of crappola they is.
I still think Honolulu should be the only point of entry for any immigrant coming from a terrorist nation. That those immigrants should be required to remain in Hawaii for at least 6 months at state expense and then a decision made by the feds on their future.
Why did the 9th circuit court do that? Such responsible behavior is way our of character.
9th Circuit embarrassed themselves once with a 9-0 ruling for Trump. They probably didn’t want to embarrass themselves again.
They got slapped down and are staying down for the count.
Why do you say that? The 9th Circuit is legally bound by the Supreme Court decision and even they are smart enough not to play around with that.
The 90 to 120 days will be over before scotus hears this , so it should be moot, unless the potus wants to push for a full decision by scotus.
One thing mealy-mouthed judges know is pecking order. They don’t want to forever ruin their chances on that next rung up the ladder.
It’s even worse. The SC granted cert and therefore has jurisdiction until the matter is decided.

Yeah, the 9th Circus was fine with kicking President Trump in the teeth, but doing it to the Supreme Court, their own peers higher up the chain, is another thing entirely. Pure politics; not based on law at all.

And Congress is doing.... *WHAT* to rectify the judicial oligarchy/over-reach??
The numb nut judges in Hawaii should go back and familiarize themselves with the term “stare decisis.” Were they familiar with it they could have saved the state and 9th Circuit a lot of money from the beginning. Case law on the president’s authority regarding immigration is well settled and has been for decades.
Stare decisis is Latin for to stand by things decided. In short, it is the doctrine of precedent. Courts cite to stare decisis when an issue has been previously brought to the court and a ruling already issued.
And when the deadline comes, Trump can sign ANOTHER executive order to extend it. FOREVER.
Not by choice.
they didn't dare take the chance to get slapped down again by SCOTUS - who signaled them out for a direct reprimand/warning... See post # 19
