The lawyer was Katyal, although I'm sure he and Chin see eye to eye on strategy. They were greedy with his proposed remedy, which if granted, would have been a District Court "rewrite" of the SCOTUS order.
In their defense, it's easy to label the first approach as greedy, with the benefit of hindsight. Now that the District and appellate courts have shown their hand, it will easy for Katyal to compose a suit that the District Court can't dodge with the same rationale it used this time around.
Also in their defense, might as well go for broke the first time. It doesn't taint the effort going forward, just makes it more complex and expensive, because they have to sue for each little broadening they have in mind.
Following on, a new suit was filed in the Hawaii District Court yesterday.

Yes but what they are considering, if they truly are, will not only result in a self inflicted black eye, it will likely bias the “Court” in future cases coming from the 9th. It may also weigh against them when considering whether to break it off into two circuits. Who knows the it could be one and the same case. Especially if one or other SCOTUS justices has retired and been replaced by then. Also the 90 day wait for ruling on the travel ban will be a slam dunk . . . Stare decisis. Trumped!

I checked posts # 19 and 40. I had thought of that, but why would they care if the Supreme Court overruled them? I think the only thing that would cause them to rule against their own (perverse) ideally would be intimidation. Why would they be intimidated by overrule? Certainly not because they see themselves in error. They are not in danger of impeachment. So why?
The Ninth Circuit doesn't mind giving the finger to SCOTUS. For many years it has done so regarding Habeus Corpus even though it knew SCOTUS would summarily and unanimously reverse. In this case, the Ninth Circuit decided it wasn't worth the trouble.
