Yes but what they are considering, if they truly are, will not only result in a self inflicted black eye, it will likely bias the “Court” in future cases coming from the 9th. It may also weigh against them when considering whether to break it off into two circuits. Who knows the it could be one and the same case. Especially if one or other SCOTUS justices has retired and been replaced by then. Also the 90 day wait for ruling on the travel ban will be a slam dunk . . . Stare decisis. Trumped!
