Big news hiding in Nina Totenbergs story on Justice Gorsuch voting 100% with Justice Thomas:
But it is unlikely that Kennedy will remain on the court for the full four years of the Trump presidency. While he long ago hired his law clerks for the coming term, he has not done so for the following term (beginning Oct. 2018), and has let applicants for those positions know he is considering retirement.
Kennedys position on the court is more than consequential. In the most hotly contested and closely divided cases, his vote often decides the outcome. With every passing day, it has become more clear that President Trumps first Supreme Court nominee, Neil Gorsuch, is probably even more conservative than the justice he replaced, Antonin Scalia.
This would put Justice Kennedys retirement right before the 2018 midterms, giving the Republican base reasons to turn out and keep the Senate with a Republican majority (already a strong possibility in 2018).
Hell be able to go out on a high note, deciding the fate of partisan gerrymandering, gay rights, and who knows what else.
UPDATE: Republicans in the Senate would have a strategic decision to make: try to confirm a replacement before the elections, or use it as a tool to boost midterm turnout.
Still praying for Ginsberg to leave.
I expect her to be gone before Kennedy. It won't be voluntary. The old girl is going to hold on till the ridiculous end.
I think Ginsberg and Breyer will both leave during Trumps term. President Trump could well have 4 SCOTUS appointments
Praise be to God, that Hillary wasn’t elected.
Amazing. 81 years old. What’s left to ‘accomplish?’ Just be gone. Unless he wants Pochahantus to appoint his successor. I could see he may put it off a year to let the anti-Trump hysteria die down but it ain’t happenin’. Next June will be an election year. The rats and the msm will make political hay of it.
Come on, STAIRCASE..!!
Ginsberg? uh, Ginsberg is up on the roof...
Maybe her good lord (Satan) will call her home.
Kennedy: the ONLY liberal on the court.
It’d do the country more good if one or more of the kooks left.
I wouldn’t mind having a liberal (or even three) on the court if the kooks didn’t always make their votes the deciding votes.
Praise be to Gd, that Hillary wasnt elected.
Trump saved America merely by getting elected. Anything more he accomplishes is gravy. And he’s already made a lot of that.
Bumpitybump!!
With Kennedy’s retirement, Gorsuch, and likely two more appointees the Supreme Court will be nearly controlled by President Trump. By the end of his second term, it will be dominated by Trump-appointed Justices.
I think we can expect to see a lot of 6-3 or maybe even 7-2 decisions by the end of Trump’s second term.
Sadly, we’re pretty much stuck with Kagan and Sotomayor for a while.
While he long ago hired his law clerks for the coming term, he has not done so for the following term (beginning Oct. 2018), and has let applicants for those positions know he is considering retirement.
Isn’t October the “coming” term?
duh 2018
