The Washington Post is reporting that Robert Mueller is now investigating President Trump for obstruction of justice, examining not only the presidents alleged statement to Comey in their February meeting, but also the firing of FBI Director James Comey.
If true, this development makes the argument even more compelling that Mueller cannot serve as special counsel. He has an egregious conflict of interest.
The special counsel statute specifically prohibits Mueller from serving if he has a personal relationship with any person substantially involved in the investigation or prosecution. The language is mandatory. He shall disqualify himself. Comey is substantially involved in the case. Indeed, he is the central witness.
The two men and former colleagues have long been friends, allies and partners. Agents have quipped that they were joined at the hip while at the Department of Justice and the FBI. They have a mentor-protégé relationship. The likelihood of prejudice and favoritism is glaring and severe.
So, it is incomprehensible that the man who is a close friend of the star witness against the president
will now determine whether the president committed a prosecutable crime in his dealings with Muellers good friend. Mueller cannot possibly be fair in judging the credibility of his friend versus the man who fired him.

Should Mueller fail to recuse himself, he should be put on notice that he is committing a crime. Prosecute him for Obstructing Trump in the Comey case(Matter).

If Mueller has any integrity at all which I think he has he'll resign.

Deputy Attorney General Rosenstein is in over his head. I bet he, and maybe even Mueller, did not anticipate Comey being a leaker.
Now that he is in, they’re not going to admit they messed up.

Mueller has the same level of integrity as Comey. Not much. These lifelong DC operatives are the major part of the swamp.
The problem is their are daring Trump to fire Muller ....
Trump need to bypass the political ramifications of firing Muller..by going to a judge or even the Supreme Court and making the case that Muller clearly must Resign because of his conflict of interest under the special prosecutor law ...let the Courts take the political out of this
Yes I know it clear that Trump should Muller if Muller will not remove himself... but that the Political trap that has been set ..You get another cry of obstruction of Justice if you fire Muller just like firing Comey
We have three coequal branches, Legislative, Executive and Judicial ... Trump HAS got to go to the Third branch the Supreme Court to end this... else anything Trump does himself to stop the witch hunt will made out as obstruction...its a political issue and that the only political play

I know Gregg pretty well - he is smart, experienced, writes very well and thoughtfully, is a very good attorney, and most important - is a good and decent person. His writings are always well researched and on point.

Trump (and his administration) should keep doing the things we elected him to do (jobs, immigration, ISIS, etc). I know he can do multiple things at once but lay off this one (directly).
EVERY SINGLE Republican outside the administration should be demanding that Mueller quits at every opportunity. Every session of congress should start with a reading of Mueller’s conflicts of interest. And any R who gets a TV interview should mention it.
Unfortunately, OUR main representative in DC has almost no allies. Besides Mueller, there are many other areas of D obstruction and delay that Rs should be talking about loudly and often. But they seem to care more about Schumer’s warnings than what Trump voters want.
Hear, hear!Trumps lawyer should be suing to have Mueller disbarred for misconduct - and Trump should fire him. Both should be done. The action to disbar would be political cover - he doesnt need legal cover, he is POTUS and as such is Muellers boss. But for political cover, Trump should make the point that by right Mueller should have been fired for lack of ethics.
The other thing Trump should, IMHO, do is actively dramatize his authority over the enforcement of laws by pardoning people. Certainly Dinesh DSouza, first. But, as a political matter also, Trump should recite everything Flynn has done for America, and pardon him preemptively. And take the heat by saying that he would have preferred that Flynn be treated in regular procedure - but that Trump has lost confidence in the process as it currently is being run. Regular procedure has been broken down by corrupt Democrats, and the president has to step in and put a halt to the problem.
If Mueller doesn’t follow the law and recuse himself, then Trump supporters no longer have to follow any law out of Thievington, DC.
Can Trump replace Rosenstein?
I agree that Trump should quickly and forcefully end this nonsense, at least within the executive branch, where he has full authority as POTUS to do so.
The risk he takes, if any, is that he could conceivably be overridden by the other two branches. If enough of the legislature turns against him he can be impeached by the House and removed by the Senate.
Republicans have nominal control of both chambers but with confused a-holes like McCain, etc. I don’t think it’s safe to take anything for granted.
I’m confident the courts will NOT have his back if the matter gets thrown in their hands.
The sad thing is that EVERYONE in both parties, in all three branches, in the MSM and in Acedemia knows perfectly well this is a nothing but a political witch hunt and yet they continue to dishonor themselves by pretending it’s not.
Lol, the fact that Mueller accepted this SC position, with such a glaring conflict of interest, eliminates any claim of having integrity.
